SUBSTITUTED TRUSTEE'S NOTICE OF SALE
WHEREAS, Chapel Ridge Apts LLC, as Trustor/Borrower, executed and delivered to Samuel M. Shiel, as Trustee for the benefit of X-Caliber Funding LLC, as Lender/Beneficiary, that certain Deed of Trust, Assignment of Leases and Rents, Security Agreement, and Fixture Filing dated as of October 19, 2021, and recorded on November 5, 2021, in Book 7272 at Page 4261 as Instrument No. 1780092 in the office of the Chancery Clerk of the First Judicial District of Hinds County, Mississippi; and
WHEREAS, X-Caliber Funding LLC transferred, conveyed, and assigned the Deed of Trust to Chapel Ridge Holdings LLC pursuant to that certain Amended and Restated Assignment and Assumption of Loan and Loan Documents recorded on October 7, 2025, in the office of the aforesaid Chancery Clerk in Book 7325 at Page 3294 as Instrument No. 1930925; and
WHEREAS, Chapel Ridge Holdings LLC appointed and substituted Underwood Law Firm PLLC as Trustee under the Deed of Trust pursuant to that certain Substitution of Trustee recorded on October 28, 2025, in the office of the aforesaid Chancery Clerk in Book 7325 at Page 6948 as Instrument No. 1932305; and
WHEREAS, default has been made in the terms and conditions of the Deed of Trust and the entire debt secured thereby has been declared due and payable in accordance with the terms of the Deed of Trust, and the legal holder of the indebtedness secured thereby, Chapel Ridge Holdings, LLC, has requested the undersigned Substituted Trustee to execute the trust and sell the property in accordance with the terms of the Deed of Trust for the purpose of raising the sums due thereunder together with attorney's fees, Substituted Trustee's fees, and expenses of sale.
NOW, THEREFORE, Underwood Law Firm PLLC, as Substituted Trustee under the Deed of Trust, will on December 5, 2025, offer for sale at public outcry to the highest bidder for cash within legal hours (between 11:00 a.m. and 4:00 p.m.) at the north front door of the Hinds County Courthouse (First Judicial District) in Jackson, Mississippi, the following described property together with all improvements thereon situated in Hinds County, Mississippi, being the same property described in the Deed of Trust:
All that certain lot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the City of Jackson, County of Hinds, State of Mississippi.
A 9.01 ACRE PARCEL BEING PART OF LOTS 9 AND 10 OF EQUITABLE INVESTMENT COMPANY, PART 1 AS RECORDED IN PLAT BOOK 4 AT PAGE 87 IN THE OFFICE OF THE CHANCERY CLERK OF HINDS COUNTY, MISSISSIPPI, AT JACKSON, MISSISSIPPI, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
BEGINNING AT A 4 INCH SQUARE CONCRETE MONUMENT MARKING THE NE CORNER OF LOT 10 OF SAID EQUITABLE INVESTMENT COMPANY, PART 1, RUN THENCE S 02 DEGREES 20 MINUTES 00 SECONDS E - 665.84 FT. ALONG THE EAST LINE OF SAID LOT 10 TO THE NORTHERLY RIGHT OF WAY OF RAYMOND ROAD; THENCE S 65 DEGREES 27 MINUTES 30 SECONDS W - 564.28 FT.
