SUMMONS SUPREME COURT : STATE OF NEW YORK COUNTY OF CHEMUNG WILLIAM J. LITTLETON and KATHRYN C. LITTLETON, Index No. 2025-6336 Plaintiffs, v. GARY W. PEREGRIM, HELEN L. PEREGRIM and JAMES HORTON, his heirs at law, devisees, successors and assigns, Defendants _________________________________________ To the above named defendants: YOU ARE HEREBY SUMMONED to answer the verified complaint in this action and to serve a copy of your answer, or, if the complaint is not served within this summons, to serve a notice of appearance on the plaintiffs' attorneys within twenty (20) days after service of this summons, exclusive of the date of service (or within thirty (30) days after service is complete if this summons is not personally delivered to you within the state of New York); and in case of your failure to appear or answer, judgment will be taken against you by default for the relief demanded in the complaint NATURE OF THE ACTION AND RELIEF SOUGHT: Plaintiffs have had continued exclusive possession of Two Ten Acre Parcels (recorded in Chemung County Clerk's Office at Liber 93 at page 327 on November 23, 1888) from at least May 31, 1986 to present, under an unwritten claim of right, exclusive of the right of any other party, and plaintiffs' possession continues to the present. Plaintiffs demand judgment that: Defendants and all persons claiming under them be forever barred from all claims to an estate or interest in the Two Ten Acre Parcels; Plaintiffs and any successors or assigns in interest be adjudged and finally determined to be the lawful owners and vested with an absolute title to the Two Ten Acre Parcels; Sole and complete possession of the Two Ten Acre Parcels be awarded to plaintiffs and any successors or assigns in interest; Plaintiffs recover their costs and disbursements against any defendant answering in this action.
