THIS MATTER, having come before the Court on this 8th day of May 2026, the Honorable Rebecca J. Bertram, J.S.C., presiding upon the motion of Plaintiff Abigey Suarez Otero, represented by Ashley Courtney, Esquire, and upon no notice to Defendant Daniel Rosello, with the Court entering this Order on the papers without oral argument and for reasons stated on the record:
IT IS on this 8th day of May 2026, hereby ORDERED that:
1. Plaintiff's motion to reinstate the complaint and provide service via publication is GRANTED.
2. Plaintiff is to publish notice in a newspaper of general circulation in the county of venue, Salem County, and, if available, by electronic means including, email, text message, and/ or social media posts. The notice shall include this Order, the motion, and divorce complaint in full. R. 4:4-5(a)(3). Notice shall state that Defendant has thirty-five (35) days to file an Answer. Ibid. Plaintiff shall also resend a copy of the Complaint by both certified and regular mail to Defendant's last known address within seven (7) days of publication. Ibid. If no answer is filed within thirty-five (35) days of publication, Plaintiff shall then provide proof of service and an affidavit of publication to the Court and may then move for a judgment by default.
3. No further relief is granted.

PLEASE TAKE NOTICE the undersigned attorney, Ashley M. Courtney, Esq. of South Jersey Legal Services, attorney for the Plaintiff, Abigey Suarez Otero a/k/a Abigey Rivera Rosello, shall move before the Superior Court of New Jersey, Chancery Division, Family Part, Salem County at 92 Market St, Salem, NJ 08079, on Friday, April 24, 2026, for an Order as follows:
1. Directing service of the Complaint in this action on Defendant, Daniel Rivera Rosello by publication, pursuant to R. 4:4-5(a)(3), on the grounds that Defendant cannot be located; and
2. Reinstating the complaint.
This Motion is made and based on the attached Certifications and all of the pleadings, records, and papers on file in this action.

AMENDED COMPLAINT FOR DIVORCE, Based on 18 Month Separation
The Plaintiff, Abigey Suarez Otero, a/k/a Abigey Rivera Rosello, whose address is protected by an Order of Protection, entered by the Superior Court of Connecticut, by way of Complaint against defendant says: Exhibit "A"
1. Plaintiff entered into a lawful marriage with the Defendant, Daniel Rivera Rosello, on July 3, 2015, in a civil ceremony in the Town of Norwich, County of New London, and State of Connecticut.
2. Plaintiff was a bona fide resident of the State of New Jersey when this cause of action arose and has ever since and for more than one year preceding the commencement of this action continues to be a bona fide resident of this state.
3. Defendant currently resides 126 Church Street, Willimantic, Connecticut 06226.
4. The parties have lived separate and apart in different habitations for a period of eighteen (18) months, commencing on or about 10 years ago. To the best of plaintiff's knowledge and belief, the parties separated somewhere on or around 2015. Ever since that time and for more than 18 consecutive months, the parties have lived separately and apart and in different locations. The separation has continued to the present time and there is no reasonable prospect of reconciliation.
5. At the expiration of the 18 months, Plaintiff was residing in the State of Pennsylvania. Plaintiff moved to Salem County, State of New Jersey in approximately 2019. Consequently, this matter is properly venued in Salem County.
6. This was plaintiff's first marriage. It is unknown to plaintiff, if defendant had any prior marriages.
7. There were no children born of the marriage and no children are expected.
8. There were no assets or debts acquired during the course of the marriage, therefore plaintiff is not seeking equitable distribution.
9. There has been one prior court proceeding between the parties:
a. Abigey Suarez vs. Daniel R. Rivera, Case Number K21NCR150330478S, Order of Protection, dated February 17, 2016, with an expiration date of December 18, 2065. Exhibit "A"
WHEREFORE, Plaintiff demands judgment:
A. Adjudging that the parties are divorced from the bonds of matrimony pursuant to N.J.S.A. 2A:34-2(d);
B. For Plaintiff to resume her maiden name of Suarez Otero and henceforth be known as Abigey Suarez Otero; and
C. For such other relief as the Court may deem equitable and just.
The Plaintiff, named above, has filed a lawsuit against you (Complaint for Divorce), in the Superior Court of New Jersey. If you dispute this complaint, you or your attorney are required to serve upon the plaintiff's attorney, South Jersey Legal Services, 415 West Landis Avenue, Second Floor, Vineland, New Jersey, 08360, either (1) a written appearance in accordance with R.5:4-3(a), or (2) an answer to the complaint, within 35 days of the date of this publication, and if you fail to answer or file a written appearance in accordance with R. 5:4-3(a), judgment by default may be rendered against you for the relief demanded in the complaint; and further, you shall promptly file the answer or written appearance and proof of service thereof in duplicate with the matrimonial filing clerk in the Superior Court, Salem County, located at 92 Market Street, Salem, NJ 08079, in accordance with the Rules of Civil Practice and Procedure.
A filing fee payable to the Treasurer, State of New Jersey and a completed Case Information Statement (available from the matrimonial clerk of the Superior Court) must accompany your answer or written appearance when it is filed. A telephone call will not protect your rights; you must file and serve a written answer or written appearance (with fee of $175.00 and completed Case Information Statement) if you want the court to hear your defense.
