General Notice
Owner is requesting Bids for the construction of the project listed above.
Bids for the construction of the Project will be received and accepted via electronic bid (vBid) through QuestCDN until April 30th, 2026, at 2:00 p.m. local time. Bids will be viewed and read via video/phone conference or at Mobridge City Hall at 114 1st Ave East, Mobridge, SD 57601, at 2:30 p.m.. Mailed or hand delivered bids will not be opened or considered. The Project includes the following Work: Construction of new aeration basins, final clarifier, biosolids dewatering system, and misc. items.

Each bid must be accompanied by a bidder's bond in a sum equal to 10% of the full amount of the bid or 5% cashier's check executed by the bidder as principal and by a surety, conditioned that if the principal's bid is accepted and a contract is awarded to the principal, the principal, within ten (10) days after the notice of the award, shall execute a contract in accordance with the terms of the bid and the bid bond, and any conditions of the City of Mobridge, as required by law. A countersignature of a bid bond is not required. The City reserves the right to reject any or all bids. If the City of Mobridge elects to award a contract to the lowest responsible bidder, and the lowest responsible bidder does not execute a contract within ten (10) days, the bidder's bond will be forfeited to the city of Mobridge, and the City of Mobridge may award the project to the next lowest responsible bidder.
Each bidder must possess a valid South Dakota tax license. Each bidder MUST enclose a copy of their Copy of South Dakota Tax License, and each license must be valid and dated at least 10 days prior to the date set for bid opening.
Refer to SDCL 10-46A regarding tax for construction services in South Dakota. Bidder must include the applicable tax in their bid price for each item of work. Direct tax questions to the South Dakota Department of Revenue 1.800.829.9188.
Bidders on this work will be required to comply with Title 40 CFR Part 33– Participation by Disadvantaged Business Enterprises in the United States Environmental Protection Agency Programs. The requirements for bidders and contractors under this regulation concern utilization of Minority Business Enterprises (MBE), Women's Business Enterprises (WBE), and Small Business Enterprises (SBE) and are explained in the specifications.
The goal for MBE is 1.5% of the total dollar value of the project. The goal for WBE is 2.4% of the total dollar value of the project. To demonstrate a good faith effort to comply, bidders must include the MBE/WBE subcontractor solicitation form in the bid package.
Bidders on this work will be required to comply with the President's Executive Order No. 11246, as amended, 11458, 11518, and 11625. The requirements for bidders and contractors under this order are explained in the specifications.
Bidders on this work will be required to comply with Davis-Bacon Wage Rates. The requirements for bidders and contractors under this law are explained in the specifications.
Bidders on this work will be required to comply with American Iron and Steel requirements of the Consolidated Appropriations Act, 2014. The requirements for bidders and contractors under this regulation are explained in the specifications.
The successful bidder— including any contractors on the project, must be registered in SAM (System for Award Management).
This project is a federally-assisted construction project funded in whole or in part with Community Development Block Grant (CDBG) funds from the U.S. Department of Housing and Urban Development, Catalog of Federal Domestic Assistance Number 14.228 Community Development Block Grants / State's Program.
All federal CDBG forms within the bid proposal packet, shall be completed and submitted with the bid. If a specific form is not applicable to the business, it should be marked "Not Applicable" and returned with the bid.
The prime contractor and all subcontractors must comply with the requirements of the BABA Act, 41 USC 8301 note, and all applicable rules and notices, as may be amended, as applicable to the Community Development Block Grant (CDBG) and Recovery Housing Program (RHP) infrastructure projects.
This project is subject to Section 3 Requirements. Any entity receiving over $200,000 in HUD funding for construction related projects must comply with Section 3. Additionally, any of the recipients' contractors receiving contracts in excess of $100,000 must also comply.
According to State Bid Law section 5-18B-1 plans and specifications must be provided to any South Dakota contractor free of charge.
Bidders on this work will be required to comply with the Equal Employment Opportunity regulations in 41 CFR Part 60 - 1.4(b) and all Civil Rights laws to include 1) Age Discrimination Act of 1975, 2) Section 13 of the FWPCA Amendments of 1972, 3) Section 504 of the Rehabilitation Act of 1973, and 4) Title VI of the Civil Rights Act of 1964.
