Sealed bids for the construction of the Project will be received by the Yankton Sioux Tribe, at Yankton Sioux Tribe Headquarters, Attn: Louis Golus, Jr., 800 Main Ave SW, Wagner, SD 57380, until 2pm CT, Thursday, July 30, 2026, at which time they will be publicly opened and read aloud.
The Project includes the following Work:
INSTALLATION OF A 10-FOOT ASPHALT PATHWAY, CULVERT EXTENSIONS, DRIVEWAY CULVERTS, GRADING, TOPSOILING, EROSOIN CONTROLS, AND STREET LIGHTING AS INDICATED IN THE BID FORM. THE PROJECT IS GENERALLY LOCATED WEST OF BIA 29, MARTY, SD ON BIA 34.

Bidding Documents may be downloaded from the designated website. Prospective Bidders are urged to register with the designated website as a plan holder, even if Bidding Documents are obtained from a plan room or source other than the designated website in either electronic or paper format. The designated website will be updated periodically with addenda, lists of registered plan holders, reports, and other information relevant to submitting a Bid for the Project. All official notifications, addenda, and other Bidding Documents will be offered only through the designated website. Neither Owner nor Engineer will be responsible for Bidding Documents, including addenda, if any, obtained from sources other than the designated website.
The Issuing Office for the Bidding Documents is: KLJ Engineering located at 5110 East 57th Street, Sioux Falls, SD 57108.
Prospective Bidders may obtain or examine the Bidding Documents at the Issuing Office on Monday through Friday between the hours of 8:00 am – 4:30 pm, and may obtain copies of the Bidding Documents as described above.
Bidding Documents may be purchased for $97 from the Issuing Office during the hours indicated above. Cost does not include shipping charges. Upon Issuing Office's receipt of payment, printed Bidding Documents or electronic documents on compact disk will be sent via the prospective Bidder's delivery service. A virtual pre-bid conference for the Project will be hosted by KLJ Engineering on July 22, 2026, at 2.00 PM central time. Attendance at the pre-bid conference is encouraged but not required. Contact Scott.Kolbinger@kljeng.com for an invitation to the pre-bid conference.
The Project shall be conducted in accordance with all applicable Laws and Regulations and the terms of the Owner's Bureau of Indian Affairs PL-638 Project Agreement as amended including the requirement that the project be listed on the TTP Transportation Improvement Program (TIP) approved by the Bureau of Indian Affairs and the Federal Highway Administration.
The Contractor shall comply with all applicable Federal civil rights laws and regulations. The Contractor shall, in all solicitation or advertisements for employees placed by or on behalf of the Contractor, state that all applicants will receive consideration for employment without regard to sex, race, creed, color, or national origin, and that a preference shall be applied for qualified Indian applicants.
This contract includes a Native American Preference. If a Native American contractor's bid is less than ten per-cent higher than a non-native American contractor's bid, the contract may be awarded to the Native American Contractor. Firms or individuals seeking such preference must submit evidence of Indian ownership and control in the sealed bid envelope.
The successful Bidder and subcontractors in performance of the construction work will be required to comply with all applicable federal labor laws including minimum wage rates decisions of the United States Department of Labor (Davis-Bacon Act) and the Yankton Sioux Tribe. The Contractor shall be required to comply with the terms and conditions of the Yankton Sioux Tribe, including Certification and Compliance of the Tribal Employment Rights Office (TERO). The TERO Information sheets and Compliance Plan are included in the Project Manual only for the Vendor's convenience, with all TERO documentation to be submitted to the proper TERO authorities listed in the documents. The Contractor must submit a letter stating proof of compliance to the Owner, copied to the Engineer, prior to commencing work. The Tribal Employment Rights Office can be contacted for questions at (605) 487-7192.
Bidders are responsible for contacting the Tribe with regard to Tribal tax laws, business license fees, and other requirements. The taxes include contractor's excise, sales and use taxes, additional information is included in the specifications. Each bid must be accompanied by a separate envelope containing the contractor's license and bid security. The bid security must be in a sum equal to at least five percent (5%) of the full amount of the bid and must be in the form of a bidder's bond. A bidder's bond must be executed by the bidder as principal and by a surety company authorized to do business in this state, conditioned that if the principal's bid is accepted and the contract awarded to the principal, the principal, within ten (10) days after notice of the award, shall execute a contract in accordance with the terms of the bid and the bid bond and any condition of the governing body. If a successful bidder does not execute a contract within ten (10) days allowed, the bidder's bond must be forfeited to the governing body and the project awarded to the next lowest responsible bidder.
All bidders must be licensed for the full amount of the bid as required by South Dakota. A contractor must be a holder or provide a written covenant to obtain said license within the time of the acceptance for Bids.
The successful Bidder will be required to furnish Contract Performance and Payment Bonds in the full amount of the contract.
Contracts shall be awarded on the basis of the lowest responsive bid submitted by a responsible bidder for the aggregate sum of all bid items. One (1) Contract will be awarded for the work.
All bids will be contained in a sealed envelope, as above provided; plainly marked showing that such envelope contains a bid for the above project. In addition, the bidder shall place upon the exterior of such envelope the following information:
1. The work covered by the bidder
2. The name of the bidder
3. Separate envelope containing bid bond and a copy of South Dakota Contractor's License or certificate of renewal. Also refer to C410 Bid form, Article 2 – Attachments to this bid for required documents.
4. Acknowledgement of the Addenda.
No Bid will be read or considered which does not fully comply with the above provisions as to Bond and licenses and any deficient Bid submitted will be resealed and returned to the Bidder immediately.
The Owner reserves the right to reject any and all bids, to waive any informality in any bid, to hold all bids for a period not to exceed 15 days from the date of opening bids, and to rebid the project until a satisfactory bid is received.
