BOROUGH OF BEACH HAVEN COUNTY OF OCEAN ORDINANCE #2026-1C AN ORDINANCE AMENDING Chapter 163, "Sewers and Sewer Utility", in the Borough Code of the Borough of Beach Haven, County of Ocean, State of New Jersey PURPOSE The purpose of this ordinance to prohibit sewer system clean outs in sidewalks or driveways. NOW THEREFORE, THE MAYOR AND COUNCIL OF THE BOROUGH OF BEACH HAVEN DO ORDAIN: SECTION I Section 163-12A(1)(e), "Sanitary sewer collection system design criteria" shall be amended as follows (underscores represent additions; strikethroughs represent deletions): (e) Every sewer service lateral shall have a clean out within 3' to 5' of the curb. Under no circumstances may any clean out be located in the sidewalk or driveway servicing the property. All sewer laterals made of nonmetallic materials shall be installed with a tracer wire from the main to the curb. In addition, the clean out at the curb shall have a top section of a metallic, ferrous iron valve box with a lid, with the marking "sewer" clearly visible. SECTION II All Ordinances or parts of Ordinances inconsistent herewith are repealed to the extent of such inconsistency. The Clerk of the Borough is authorized to renumber and/or re-codify any sections affected by such repeal to the extent consistent with this Ordinance. SECTION III If any word, phrase, clause, sections, or provision of this Ordinance shall be found by any Court of competent jurisdiction to be unenforceable, illegal, or unconstitutional, such word, phrase, clause, section, or provision shall be severable from the balance of the Ordinance and the remainder of the Ordinance shall remain in full force and effect. SECTION IV This Ordinance shall take effect upon publication thereof after final passage according to law.
