ORDINANCE NO. 26-CODE-986
An Ordinance of the Borough of Oakland, County of Bergen, State of New Jersey Amending the Zoning Map of the Borough of Oakland to Re-Zone the Property Known as McBride Property Pursuant to the Municipal Land Use Law (N.J.S.A. 40:55D-1 et seq.)
PLEASE TAKE NOTICE that the Mayor and Council of the Borough of Oakland have introduced Ordinance No. 26-CODE-986, which amends Chapter 59 of the Borough Code and the Official Zoning Map of the Borough of Oakland to establish a new zoning district known as the RA-6AH Affordable Housing Zone for property commonly referred to as the "McBride Property"
The ordinance creates the RA-6AH Affordable Housing Zone for the tract identified as Block 3301, Lot 2 and Block 3401, Lots 11, 12, 19, 40–43, 52, 53, 57, and 58. The purpose of the rezoning is to facilitate inclusionary residential development in furtherance of the Borough's constitutional affordable housing obligation and its Fourth Round Housing Element and Fair Share Plan.
The ordinance permits development of the tract as an inclusionary residential community consisting of up to 240 dwelling units, including attached single-family townhouses, stacked townhouses, and multifamily flats, with a mandatory minimum affordable housing set-aside of twenty percent (20%) of all units. Affordable units must comply with all applicable requirements of the New Jersey Fair Housing Act, Uniform Housing Affordability Controls (UHAC), and the Borough's Affordable Housing Ordinance.
The ordinance establishes bulk standards, tract-wide coverage limitations, building height restrictions, open space requirements, infrastructure standards, and affordable housing controls specific to the RA-6AH Zone.
The above ordinance was introduced at a meeting of the Mayor and Borough Council held on February 24, 2026. Adoption of this ordinance will be considered at a meeting to be held at the Municipal Court/Council Chambers, 10 Lawlor Drive, Oakland, N.J., on March 12, 2026 commencing at 7:00 p.m., at which time and place all persons interested therein or affected thereby will be given an opportunity to be heard concerning same. Copies of this ordinance are available at the Municipal Building up to the time of the public hearing for members of the public who request the same.
