BOROUGH OF RIVERDALE PLANNING BOARD
PLEASE TAKE NOTICE that on the 23rd day of October 2025 at 7:30PM a hearing will be held before the Riverdale Planning Board/Zoning Board of Adjustment on the appeal or application of the undersigned for the following relief for the Riverdale Zoning Ordinance:
The Site Plans prepared by the Applicant's Engineer indicates six (6) variances are required for the proposed development: six (6) variances are required on proposed office building lot (Lot 18.03) and no variances on the residential lot (Lot 18.04). The variances for proposed Lot 18.03 relate to the detached garage and the monument sign, as summarized by the following:
Monument Sign on Lot 18.03: Borough Code §168-27(C)(15) Monument Sign setback to front property line 10' minimum required, where no less than 5' proposed.
Detached Garage on Lot 18.03: Per Borough Code §168-9, Schedule B, Accessory/Conditional Uses, one (1) detached garage is permitted as an accessory use in the PO zone if located in the side or rear yard. However, according to Borough Code §168-11, Schedule D, Bulk Requirements, "n/a" is listed under the column for Accessory Building controls for Side Line, Rear Line, Distance from Other Buildings, Maximum Coverage, and Maximum Height. No prohibition or language related to accessory structures within the PO Zone appears under Borough Code §168-30 "Accessory buildings." Based upon the inconsistency in the Borough Code, the Applicant has noticed for bulk variances in connection with the detached garage from the list of controls outlined under Borough Code §168-11, Schedule D, as follows:
(i) Accessory Building side yard setback:
(ii) Accessory Building rear yard setback:
(iii) Accessory Building other building setback:
(iv) Accessory Building maximum coverage: and,
(v) Accessory Building maximum building height
Further, the Applicant is seeking a minor subdivision pursuant to section 35 of P.L. 1975, c.291(C.40:55D-47).
With regard to premises located at 30 Newark Pompton Tpk., designated as Block 14.02 Lot 18.01 on the Official Tax Map of the Borough of Riverdale.
The application and all relevant maps and papers are on file in the office of the Planning Secretary and are available for inspection during normal business hours.
Any interested party may appear at said hearing and participate therein in accordance with the rules of the Planning Board.
