AN ORDINANCE AMENDING THE JOHNSTON REVISED ORDINANCES OF 2007 BY AMENDING THE OFFICIAL ZONING MAP TO REZONE 6.36 ACRES From R-1 (75), Medium Lot Residential To R-1 (75), Medium Lot Residential With A-K, Animal Keeping Overlay
WHEREAS, the Planning and Zoning Commission reviewed this item at their regular meeting on January 27th, 2025 and recommends approval of the proposed rezoning; and,
NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JOHNSTON, IOWA THAT:
SECTION 1. PURPOSE. The purpose of this ordinance is to change the Official Zoning Map of the City of Johnston, Iowa, under the provisions of Chapters 165 to 190 (Zoning Ordinance), Chapter 166 (General Provisions), Section 167.02 (District Boundaries and Official Zoning Map) of the Johnston Municipal Code.
SECTION 2. OFFICIAL ZONING MAP AMENDED FROM R-1 (75), Medium Lot Residential To R-1 (75), Medium Lot Residential With A-K, Animal Keeping Overlay. The following legally described property is hereby rezoned from R-1 (75), Medium Lot Residential To R-1 (75), Medium Lot Residential With A-K, Animal Keeping Overlay:
A PART OF LOT 1 AND LOT 2, BEAVER FARMS, AN OFFICIAL PLAT, NOW INCLUDED IN AND FORMING A PART OF THE CITY OF JOHNSTON, POLK COUNTY, IOWA AND DESCRIBED AS FOLLOWS:
BEGINNING AT THE NORTHWEST CORNER OF SAID LOT 2; THENCE NORTH 89°03'47" EAST ALONG THE NORTH LINE OF SAID LOT 2, A DISTANCE OF 327.93 FEET TO THE NORTHEAST CORNER OF SAID LOT 2 ALSO BEING THE NORTHWEST CORNER OF SAID LOT 1; THENCE NORTH 89°06'17" EAST ALONG THE NORTH LINE OF SAID LOT 1, A DISTANCE OF 198.45 FEET TO THE NORTHWEST CORNER OF LOT B, LANGWITH COMMONS, AN OFFICIAL PLAT ; THENCE SOUTH 00°00'29" WEST ALONG THE WEST LINE OF SAID LANGWITH COMMONS, 631.54 FEET TO THE NORTH RIGHT-OF-WAY LINE OF NW 55TH AVENUE; THENCE SOUTH 89°03'19" WEST ALONG SAID NORTH RIGHT-OF-WAY LINE, 197.16 FEET TO THE WEST LINE OF SAID LOT 1; THENCE CONTINUING SOUTH 89°03'19" WEST ALONG SAID NORTH LINE, 112.06 FEET TO THE EAST LINE OF THE WEST 217 FEET OF THE SOUTH 266 FEET OF SAID LOT 2; THENCE NORTH 00°23'19" WEST ALONG SAID EAST LINE, 258.06 FEET TO THE NORTHEAST CORNER OF SAID WEST 217 FEET OF THE SOUTH 266 FEET OF SAID LOT 2; THENCE SOUTH 88°55'42" WEST ALONG THE NORTH LINE OF SAID WEST 217 FEET OF THE SOUTH 266 FEET OF SAID LOT 2, A DISTANCE OF 216.75 FEET TO THE NORTHWEST CORNER OF SAID WEST 217 FEET OF THE SOUTH 266 FEET OF SAID LOT 2; THENCE NORTH 00°12'57" EAST ALONG THE WEST LINE OF SAID LOT 2, A DISTANCE OF 374.19 FEET TO THE POINT OF BEGINNING AND CONTAINING 6.36 ACRES (276,971 S.F.).
PROPERTY SUBJECT TO ANY AND ALL EASEMENTS OF RECORD.
SECTION 3. REPEALER. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
SECTION 4. SEVERABILITY CLAUSE. If any section, provision, or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
SECTION 5. WHEN EFFECTIVE. This ordinance shall be in full effect from and after its final passage, approval, and publication as provided by law.
