FINAL NOTICE AND PUBLIC EXPLANATION OF A PROPOSED ACTIVITY IN A FEDERAL FLOOD RISK MANAGEMENT STANDARD DESIGNATED FLOODPLAIN AND WETLAND
This is to give notice that Florida Housing Finance Corporation, as Responsible Entity under 24 CFR Part 58 has conducted an evaluation as required by Executive Order 11988, as amended by Executive Order 13690 and/or Executive Order 11990, in accordance with HUD regulations at 24 CFR 55.20 in Subpart C Procedures for Making Determinations on Floodplain Management and Wetlands Protection. The activity is funded under U.S. Department of Housing and Urban Development's Community Development Block Grant - Disaster Recovery (CDBG-DR) Program, Hurricane Ian - Workforce Affordable Housing Program, Florida Commerce Agreement Number: HI001. The proposed project is located at 1505 Cogswell Street in Rockledge, Brevard County, FL and is located in the Federal Flood Risk Management Standard (FFRMS) floodplain. The extent of the FFRMS floodplain was determined using the 0.2 percent flood approach. The project consists of the construction of an affordable multi-family development with approximately 100 living units. Approximately 0.38 acres of the project site lies within a Special Flood Hazard Area (Zone AE, 100-year floodplain), while the remaining ±3.78 acres are in Zone X. The project will include compliance with all applicable floodplain regulations, local codes, and any required mitigation measures such as elevation or floodproofing as determined through permitting.
Florida Housing Finance Corporation has considered the following alternatives and mitigation measures to minimize adverse impacts and to restore and preserve natural and beneficial functions and intrinsic values of the existing floodplain/wetland: Construction of the proposed project entirely outside the FFRMS floodplain was deemed not practicable given site availability, surrounding land use patterns, cost effectiveness, and proximity to necessary infrastructure and services in the Rockledge area. The No-Build Alternative was eliminated because it would fail to meet the project's purpose of providing critically needed workforce affordable housing in a Hurricane Ian recovery priority area. The proposed project will comply with all state and local floodplain protection procedures and ordinances. Mitigation measures include adherence to local building codes, floodplain permitting requirements, and any elevation or design standards necessary to minimize flood risks.
FHFC has reevaluated alternatives to building in the floodplain/wetland and has determined that it has no practicable alternative to FFRMS floodplain development. Environmental files documenting compliance with Executive Order 11988, as amended by Executive Order 11990, are available for public inspection, review and copying upon request at the times and location delineated in the last paragraph of this notice for receipt of comments.
There are three primary purposes for this notice. First, people who may be affected by activities in floodplain/wetland and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplain/wetland can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplain/wetland, it must inform those who may be put at greater or continued risk.

REQUEST FOR RELEASE OF FUNDS
On or about June 9, 2026, the Florida Housing Finance Corporation (FHFC) will submit a request to the Florida Department of Commerce, Office of Long-Term Resiliency for the release of CDBG-DR funds pursuant to 24 CFR Part 58, under Title I of the Housing and Community Development Act of 1974, as amended, to undertake the Ekos at Rockledge Park project for the purpose of constructing approximately 100 units of workforce affordable multi-family housing in Rockledge, Brevard County, Florida (estimated funding includes CDBG-DR and other non-HUD sources).
FINDING OF NO SIGNIFICANT IMPACT
The Florida Housing Finance Corporation has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at Florida Housing Finance Corporation office (address above) and may be examined or copied weekdays 9 A.M to 4 P.M.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the RE at the address above. All comments received by June 8, 2026 will be considered by the Florida Housing Finance Corporation prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
ENVIRONMENTAL CERTIFICATION
FHFC certifies to the Florida Department of Commerce, as the responsible entity under 24 CFR Part 58, that Ms. Angeliki Sellers, in her capacity as Chief Financial Officer and duly authorized Certifying Officer, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. Florida Commerce's approval of the certification satisfies the environmental review requirements under NEPA and related laws and authorities and allows FHFC to use CDBG-DR Program funds.
OBJECTIONS TO RELEASE OF FUNDS
Florida-Commerce will accept objections to its release of funds and the Florida Housing Finance Corporation's certification for a period of fifteen (15) days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Florida Housing Finance Corporation; (b) the Florida Housing Finance Corporation has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the development process have committed funds, or incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by Florida-Commerce; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted via email in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Florida-Commerce Office of Long-Term Resiliency, CDBG-DR Program, 107 East Madison Street, Tallahassee, FL 32399. Potential objectors should contact Florida-Commerce to verify the actual last day of the objection period.
