TO: All Unknown Heirs, Devisees, or Legal Representatives of any former owners of a certain parcel of Land located on Central Street in Auburn, Massachusetts, Map 041, Parcel 016 on the Town of Auburn's Assessor's maps.
You are hereby notified that a complaint has been filed by the above-named plaintiff in which you are named as an interested party. This complaint concerns an unnumbered parcel of land located on Central Street in Auburn, Worcester County, in said Commonwealth being purportedly identified as Map 041, Parcel 016 on the Town of Auburn's Assessor's maps (the "Property"). Title is clouded by an uncertain chain of title. Plaintiff alleges that it claims title to the Property by virtue of longstanding municipal ownership and control, as reflected in the Town of Auburn's assessor's records, which purportedly indicate that the Property has been carried in the name of the Town of Auburn since at least on or about August 16, 1906. Plaintiff further alleges that the Property was not historically conveyed as a separately described parcel but rather emerged as a distinct tract through the alteration of land formerly comprising part of a larger parcel, including land that was previously submerged beneath a pond or water body, and that no separate deed or instrument of record was created to reflect such transformation. Plaintiff seeks a decree determining that it holds title to the Property free and clear of any right, title, estate, lien or interest of the defendants and such other relief as this court deems just and proper.

If you intend to make any defense, you are hereby required to serve upon the plaintiff's attorneys, Robert J. Hennigan, Jr., Esq., and Adam F. Kobel, Esq. both of he Law Office of Robert J. Hennigan, Jr., whose address is 390 Main Street, Suite 600, Worcester, Massachusetts 01608, an answer to the complaint on or before the twenty-ninth day of June, 2026, next, the return day, hereof, and a copy thereof must be filed in this court on or before said day.
If you fail to do so, judgment by default will be taken against you for relief demanded in the complaint. Unless otherwise provided by Rule 13(a), your answer must state as a counterclaim any claim which you may have against the plaintiff which arise out of the transaction or occurrence that is the subject matter of the plaintiffs' claim, or you will thereafter be barred from making such claim in any other action.
It is ORDERED that notice be given by publishing a copy of this notice once in the Worcester Telegram & Gazette, a newspaper of general circulation in the Worcester County, Massachusetts at least thirty days before the twenty-ninth day of June, 2026.
