Code 36-7-9-1, et seq., you are hereby ORDERED to secure and make safe the structures and buildings located on the premises known as Post Office Address: 52349 Prescott Ave., South Bend, Indiana 46637 and more particularly described as follows: For APN/Parcel ID(s): 71-03-24-255-010.000-003 LOTS NUMBERED TWO HUNDRED FIFTY-ONE (251) AND TWO HUNDRED FIFTY-TWO (252) AS SHOWN ON THE RECORDED PLAT OF FULKERSON PARK, RECORDED IN PLAT BOOK 12, PAGE 190, IN THE OFFICE OF THE RECORDER OF ST.JOSEPH COUNTY, INDIANA. All buildings and structures located on said real estate must be completely secured and made safe, and the work must satisfactorily pass inspection by the Office of the Building Department, St. Joseph County, Indiana before June 16, 2026. You are notified that there will be a hearing held before the County Commissioners of St. Joseph County, Indiana, in the Council Chambers, 4th Floor of the County-City Building located at 227 West Jefferson Boulevard in the City of South Bend, St. Joseph County, State of Indiana, on June 16, 2026 at 6:00 p.m., at which hearing you have a right to appear, with or without legal counsel, to present evidence, to cross-examine opposing witnesses, and present arguments for the purpose of determining whether or not this Order has been complied with and whether or not this Order shall continue in full force and effect. The purpose of this hearing is to determine whether or not the property in question is unsafe as defined by Indiana law, Ind. Code 36-7-9-4, et seq., all as adopted by County Ordinance No. 93-82. You have a right to appear at the hearing of this cause, with or without legal counsel, and if you fail to appear the hearing will be held in your absence and the result may be one or more of the following: An Order for immediate demolition. An Order to make repairs, if repairs are possible and/or economically feasible, and The granting of an extension of time within which to make repairs if such request is made (assuming that repairs are to be made). At the hearing, the County Commissioners of St. Joseph County, Indiana may determine that the property is abandoned pursuant to Ind. Code 36-7-37 et seq. Legal proceedings may follow to enforce compliance with Orders made by the County Commissioners of St. Joseph County, Indiana at such hearing. You are further notified that, pursuant to Indiana Code 36-7-9-27, you are required to supply information of these pending proceedings and this Order to any person or persons who may take or agree to take a substantial interest in the real estate in question inasmuch as these proceedings constitute a lien on said real estate. In addition, within five (5) days after transferring or agreeing to transfer a substantial property interest in the property, you must provide the undersigned with the full name, address and telephone number of the person taking a substantial property interest in the property and provide the undersigned the legal instrument under which the transfer or agreement to transfer the substantial property interest is accomplished. Any respondent, or person, named hereinabove is obligated to comply with the provisions of this Order until such time as a hearing is held on the date and time aforementioned, and further you are directed to notify any persons known to you to have an interest in said real estate of the pendency of this Order and of the aforementioned hearing date.
