Notice of 401 WQC Application pursuant to
33 U.S.C. 1341 and M.G.L. Chapter 21
Outermost Harbor Marine
PUBLIC NOTICE:
Pursuant to 33 U.S.C. 1341 and M.G.L c. 21 §§ 26-53, notice is given of a 401 Water Quality Certification (WQC) application for a 10-year comprehensive maintenance dredge permit in Chatham, MA by Outermost Harbor Marine located at 83 Seagull Road in Chatham, MA 02633. The purpose of the Project is to permit future dredging and beach nourishment activities to support Outermost Harbor Marine's usage of the only channel which provides access to Chatham Harbor and waters beyond, as well as to provide sand nourishment for a barrier beach (Quitnesset Spit) and adjacent coastal beaches on the Monomoy National Wildlife Refuge. Work will entail the dredging of 4,704 cubic yards of sediment and therefore, in accordance with 314 CMR 9.04(1), authorization is required under Section 401 of the Clean Water Act. Within 21 days of this notice. The Department will consider all written comments on this 401 WQC Application received by the Public Comments Deadline.
Any group of ten persons of the Commonwealth, any aggrieved person, or any government body or private organization with a mandate to protect the environment that has submitted written comments may also appeal the Department's Certification and that failure to submit comments before the end of public comment period may result in the waiver of any right to an adjudicatory hearing.
