Notice of Public Hearing to Adopt Rules
A public hearing will be held in the second floor conference room of the Sutherland Building, 118 West Capitol Ave, Pierre, South Dakota, on July 21, 2026 from 3:00 p.m. Central Time until 4:00 p.m. Central Time, to consider the adoption and amendments of Administrative Rules of South Dakota numbered:
§§ 24:06:07:02, 24:06:07:03.01, 24:06:07:04, 24:06:07:06, 24:06:07:07, 24:06:08:02, 24:06:08:03, 24:06:08:04, 24:06:08:06, 61:23:01:04, 61:25:01:02, 61:33:01:03, 61:33:01:04, 61:33:01:13, 67:55:01:04, 67:55:02:06, 67:55:02:11, 67:55:04:14.
The effect of the rules will be to adopt the 2025 edition of the National School Transportation Specifications and Procedures manual; amend school bus rules to reflect the correct referenced page numbers; adopt the 2026 edition of the Commercial Vehicle Safety Alliance handbook; adopt English proficiency requirements; authorize permits and adopt requirements for the use of industrial incinerators; and amend victims services rules.
The reason for adopting the proposed rules is to implement the most current version of the National School Transportation Specifications and Procedures manual; implement the most current version of the Commercial Vehicle Safety Alliance handbook; add English proficiency requirements for commercial driver applicants; provide authorization for granting burn permits for the use of industrial incinerators; and amend victims services rules to revise the list of individuals authorized to submit a claim for compensation, to clarify service requirements for hearing and decision notices, and to address authorized expenses for homicide scene cleanup.
Persons interested in presenting amendments, data, opinions, and arguments for or against the proposed rules may appear in-person at the hearing, or mail or e-mail them to South Dakota Department of Public Safety, 118 West Capitol Avenue, Pierre, South Dakota 57501 or email them to DPSInfo@state.sd.us. The deadline to submit any such written comments for consideration by this agency is July 31, 2026, ten days after the date of the public hearing.
After the written comment period, the Department of Public Safety will consider all written and oral comments it receives on the proposed rules. The Department of Public Safety may modify or amend a proposed rule at that time to include or exclude matters that are described in this notice.
