Early Notice and Public Review of a Proposed
Activity in a Federal Flood Risk Management Standard Designated Floodplain

This is to give notice that HUD under 24 CFR Part 50 has determined that the following proposed action under Multifamily PBRA CT26M000222 is located in the Federal Flood Risk Management Standard (FFRMS) floodplain and Regulatory Floodway, and HUD will be identifying and evaluating practicable alternatives to locating the action within the floodplain and the potential impacts on the floodplain from the proposed action, as required by Executive Order 11988, as amended by Executive Order 13690 and/or Executive Order 11990, in accordance with HUD regulations at 24 CFR 55.20 in Subpart C Procedures for Making Determinations on Floodplain Management and Protection of Wetlands. The proposed project, known as Mohegan Commons, location is 20 East Baltic Street and 90 North Street in Norwich, New London County, Connecticut. The extent of the FFRMS floodplain was determined using the Freeboard Value Approach (FVA).
20 East Baltic – The Subject Property is depicted on the Federal Emergency Management Agency (FEMA) Flood Insurance Rate Map (FIRM) #09011C0212G, dated July 18, 2011. The FEMA Map indicates that the majority of the Subject Property is located within Zone X (Unshaded), which is designated as an area outside the 100- and 500-year floodplains. An area along the central portion of the Subject Property is located within the Special Flood Hazard Area (SFHA) Regulatory Floodway. A small area along the southern portion of the Subject Property is located within SFHA Zone AE, designated as the 100-year floodplain, a FEMA-designated Special Flood Hazard Area (SFHA) with the Base Flood Elevation (BFE) defined. According to the FEMA FIRM, the SFHA BFE ranges from 127- to 132-feet above mean sea level (amsl). As such, the FVA was calculated by adding two-feet for non-critical actions to the elevation for the SFHA, which determined that the FFRMS elevation for this floodplain ranges from 129- to 134-feet amsl.
90 North Street - The FEMA Map indicates that the eastern and western portions of the Subject Property are located within Zone X (Unshaded), which is designated as an area outside the 100- and 500-year floodplains. An area along the central portion of the Subject Property is located within the SFHA Regulatory Floodway. The remaining areas through the eastern and western portions of the Subject Property are located within SFHA Zone AE, designated as the 100-year floodplain, a FEMA-designated Special Flood Hazard Area (SFHA) with the Base Flood Elevation (BFE) defined. According to the FEMA FIRM, the SFHA BFE ranges from 126- to 127-feet above mean sea level (amsl). As such, the FVA was calculated by adding two-feet for non-critical actions to the elevation for the SFHA, which determined that the FFRMS elevation for this floodplain ranges from 128- to 129-feet amsl.
According to the Elevation Certificates and Surveys provided, none of the residential buildings are located within the SFHA Regulatory Floodway and are located above the BFE. Areas that remain within the SFHA Regulatory Floodway and SFHA Zone AE include Parking lots, ingress/egress areas, sidewalks, landscaping, and amenity areas. Areas that are located within the FRMS include the majority of both properties.
For buildings located within the SFHA Zone AE, flood insurance is current and available. The project is located within a community (City of Norwich CID 090102D) that is participating in the National Flood Insurance Program (NFIP).
Alternative Processing, per 24 CFR Part 55.21 is being completed by HUD due to the presence of site features beyond de minimis located within the SFHA Regulatory Floodway. Additionally, the 8-Step Decision-Making process per 24 CFR Part 55.20 is occurring.
No activities altering the buildings or site layout are proposed. The project is seeking capital repairs
which includes repairs such as unit interiors, amazon package lockers, upgrade to the current library, dog park, bike racks, updated playground, updated cable and WIFI, repair interior hallways, and parking lots repairs. No alternative sites outside of the SFHA Zone AE and Regulatory Floodway were sought due to the financial burden of relocating residents.
There are three primary purposes for this notice. First, people who may be affected by activities in floodplain and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Commenters are encouraged to offer alternative sites outside of the floodplain, alternative methods to serve the same project purpose, and methods to minimize and mitigate project impacts on the floodplain. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplain can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplain, it must inform those who may be put at greater or continued risk.

Ashmore, Production Division Director, Northeast Region. A full description of the project may also be reviewed from 9:00 am to 5:00 pm, Monday through Friday at the above-mentioned address. Comments may also be submitted via email at NE.PublicNotice@hud.gov within fifteen (15) days after publication of this notice, on or before December 28, 2025.
