To Heather M. Spellman of Bourne, MA and to all other persons interested. A petition has been presented to said Court by Dorothy Destefano of Rehoboth, MA, representing that she holds as tenants in common undivided part or share of certain land lying in Bourne in said County, and briefly described as follows
The land and buildings and improvements thereon in the Town of Bourne, Barnstable County Massachusetts, bounded and described as follows:
Certain real estate situated in Bourne (Gray Gables) in the County of Barnstable, Massachusetts, being lot 320 as shown on a plan entitled "plan of Gray Gables Bourne Mass." dated July 30th, 1923, Russell H. Whiting C ., duly filed with Barnstable County Registry of Deeds, bounded:
Easterly by Presidents Road, as shown on said plan, seventy (70) feet;
Northerly by Lot x, as shown on said plan, ninety-one (91) feet, more or less, to the high water mark of Buzzards Bay;
Westerly by the high water mark of Buzzards Bay, fifty-nine (59) feet. more or less, to the dividing line between Lots 320, 321, as shown on said plan; and
Southerly by the last named line, one hundred twenty (120) feet, more or less, to the point of beginning.
Containing about 6,500 square feet, more or less, according to said plan.
Subject to all restrictions of record insofar as the same are presently applicable and in force.
There is also granted as appurtenant to the above described premises, a right of way in common with all others now or hereafter lawfully entitled thereto to use for all purposes for which streets are used, the streets and roads as shown on said plan, and a right to pass and re-pass on foot over the passageways as shown on said plans.
setting forth that she desire that all of said land may be sold at private sale for not less than One Million Four Hundred Eighty Thousand Dollars (1,480,000.00) and to that end that a commissioner be appointed to make such partition and be ordered to make sale and conveyance of all, or any part of said land which the Court finds cannot be advantageously divided.
If you desire to object thereto you or your attorney should file a written appearance in said Court at Barnstable before ten o'clock in the forenoon on October 27, 2025, the return day of this citation.
