Legal Notice
PLEASE TAKE NOTICE that Palisades Properties, LLC (the "Applicant"), the lessee of property commonly known as 21 Wood Chase Lane and listed on the Borough of Kinnelon Tax Assessment Map as Block 56301, Lot 137 (the "Property") has filed a request for interpretation with the Zoning Board of Adjustment of the Borough of Kinnelon (the "Board"), to determine whether the residents of the Cooperative Sober Living Residence ("CSLR") that is operating on the Property are considered a "family" under the Borough code and applicable case law, and that said residents may reside in a single-family dwelling in the Borough's Residential Zone, without the need for a use variance or reasonable accommodation. This CSLR provides a home for up to ten (10) individuals to reside while they receive outpatient treatment for drug and alcohol addiction at a separate location. A live in house manager also resides at the Property to supervise the individuals. These individuals and the house manager are the "residents" of the CSLR.
By way of background, Applicant had previously filed suit against the Board, with respect to its denial of a d(1) use variance/reasonable accommodation related to the CSLR use on the Property. That suit is entitled as Palisades Properties, LLC v. The Zoning Board of Adjustment of the Borough of Kinnelon, et al., Civil Action No: 2:25-cv-17754-BRM-JBC. Judge Martinotti has remanded this matter back to the Board, so that it may act on the above request for interpretation.
The Applicant also seeks approval for any and all other variances, waivers, exceptions, interpretations, and any other incidental relief that may be required or deemed necessary during the review and consideration of this application by the Board and its professionals and by the Applicant during the public hearing process, including but not limited to that which may be generated by way of revised submissions.
This matter will be heard by the Board on June 9, 2026 at 7:00 PM in the Municipal Building, Council Chambers, 130 Kinnelon Road, Kinnelon, New Jersey, or as soon thereafter as the matter may be heard, at which time you may appear either in person or be represented by an attorney and present any testimony which you may have regarding this application.
