NOTICE OF SEIZURE OF THE M/V ATLANTIC POWER and M/V ATLANTIC WIND. Let all men know by these premises that, on or about November 6, 2025, the M/V ATLANTIC POWER and the M/V ATLANTIC WIND were seized and arrested by G. Robert Toney of National Maritime Services, Inc., as specifically appointed and deputized by Order of the U.S. District Court for the Western District of Louisiana to arrest said vessels in lieu of the U.S. Marshals Service, in connection with the civil action now pending before the Honorable Judge Robert R. Summerhays entitled: Fleetzero Inc. v. M/V ATLANTIC POWER, bearing Official No. 1059685, her engines, tackle, furniture, apparel, appurtenances, etc., in rem, M/V ATLANTIC WIND, bearing Official No. 9270347, her engines, tackle, furniture, apparel, appurtenances, etc., in rem, and Atlantic Oceanic, LLC, in personam, in Civil Action Number 6:25-cv-01686, in the United States District Court for the Western District of Louisiana.
Plaintiff, Fleetzero Inc., in the above referenced suit is represented by the following attorneys: L. ETIENNE BALART and SARA B. Any party who asserts a right of possession or any ownership interest in the M/V ATLANTIC POWER or the M/V ATLANTIC WIND must file its right of possession or any ownership interest pursuant to Rule C(6) of the Supplemental Federal Rules of Civil Procedure for Certain Admiralty and Maritime Claims and Local Admiralty Rule 64.1 with the Clerk of the United States District Court for the Western District of Louisiana and serve such statement on the above referenced attorneys within 21 days of December 3, 2025, which is the first publication of this notice and must serve an answer within 21 days after filing such right of possession or any ownership interest. If any party having any interest in the M/V ATLANTIC POWER or the M/V ATLANTIC WIND does not file a claim or answer within the time period described above, default may be entered and condemnation ordered. Application for intervention under FRCP 24, by persons asserting right of possession or any ownership interest in the property that is the subject of the action or other interests may be untimely if not filed within the time allowed for asserting right of possession or any ownership interest in the property that is the subject of the action.
