MORTGAGEE'S NOTICE OF SALE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Michael M. Howarth to Mortgage Electronic Registration Systems, Inc. ("MERS") as Nominee for GMAC Mortgage, LLC f/k/a GMAC Mortgage Corporation dated October 26, 2007 and filed with the Bristol (Fall River) Registry of Deeds District of the Land Court as Document No. 39451 and noted on Certificate of Title No. 6350; which mortgage was assigned to Green Tree Servicing LLC by Assignment dated April 19, 2013, filed as Document No. 45100; further assigned to New Residential Mortgage LLC by Assignment dated February 18, 2020, filed as Document No. 51361; further assigned to Federal National Mortgage Association by Assignment dated September 21, 2021, filed as Document No. 52972; further assigned to J.P. Morgan Mortgage Acquisition Corp. by Assignment dated September 21, 2021, filed as Document No. 52973; and further assigned to Wilmington Savings Fund Society, FSB, as Owner Trustee of the Residential Credit Opportunities Trust IX-A by Assignment dated May 20, 2025 filed as Document No. 56034, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 11:00 AM, on the 9th day of April, 2026, at the mortgaged premises described and known as 24-26 School Street, Fall River, Massachusetts described in said mortgage, to wit:
A certain parcel of land with all buildings thereon and improvements thereto, in Fall River, Bristol County, Massachusetts, known as 26 School Street, Fall River, Massachusetts, bounded and more particularly described as follows:
EASTERLY by School Street fifty-nine and 86/100 (59.86) feet;
SOUTHERLY by land now or formerly of Margaret Peters and land now or formerly of Annie H. Miley eighty (80) feet; WESTERLY by land now or formerly of Hannah R. Hall fifty-nine and 88/100 (59.88) feet; and NORTHERLY by land now or formerly of Josiah Brown et al eighty (80) feet. All of said boundaries are determined by the Court to be located as shown on a plan drawn by
E.M. Corbett, Surveyor, dated November 1909, as approved by the Comi, filed in the Land Registration Office, a copy of a portion of which is filed with Original Certificate of Title #38, Book 1, Page 93, Fall River District of the Land Court. The Mortgagee reserves the right to postpone the sale to a later date by public proclamation at the time and date appointed for the sale and to further postpone at any adjourned sale date by public proclamation at the time and date appointed for the adjourned sale date. The Mortgagee further reserves the right to open the bidding at the time, date and place appointed for sale, and if no bids are received, or the bids received are deemed unacceptable to Mortgagee, to postpone the sale to a later date by public proclamation. Said premises will be sold subject to and with the benefit of all restrictions, easements, improvements, outstanding tax titles, mortgages, liens, rights of tenants and parties in possession, unpaid taxes, municipal liens and other public taxes, assessments or liens, having priority over the mortgage described herein, if any. In the event that the successful bidder at the foreclosure sale shall default in purchasing the within described property according to the terms of this Notice of Sale and/or the terms of the Memorandum of Sale executed at the time of the foreclosure, the Mortgagee reserves the right to sell the property by Foreclosure Deed to the second highest bidder provided that the second highest bidder shall deposit with Mortgagee's attorneys the amount of the required deposit as set forth herein within three (3) business days after written notice of default of the previous highest bidder and title shall be conveyed to said second highest bidder within twenty (20) days of said written notice. TERMS OF SALE: Ten Thousand Dollars ($10,000.00) will be required to bid and be paid in cash or by certified check at the time and place of sale as earnest money. The balance is to be paid in cash or by certified check within thirty (30) days of the date of the sale at the Law Office of Michael J. Murphy, 5 Commonwealth Road, Natick, Massachusetts 01760. The description of the premises contained in said mortgage shall control in the event of any typographical error in this publication.
