By virtue and in execution of the Power of Sale contained in a certain mortgage given by Phitsamay A. Houatchanthara and David Gouin to Mortgage Electronic Registration Systems, Inc. ("MERS") as Nominee for Security First Mortgage Funding, LLC dated October 23, 2017, recorded with Worcester South Registry of Deeds in Book 57919, Page 324; which mortgage was assigned to SunTrust Bank by Assignment dated November 7, 2018, recorded in Book 59669, Page 257; further assigned to Specialized Loan Servicing LLC by Assignment dated December 1, 2021, recorded in Book 66657, Page 293; and further assigned to Wilmington Savings Fund Society, FSB, as Owner Trustee of the Residential Credit Opportunities Trust IX-B by Assignment dated August 11, 2025, recorded in Book 72384, Page 28; as affected by Assignment dated December 2, 2025, recorded in Book 72922, Page 280, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 11:00 AM, on the 14th day of April , 2026, at the mortgaged premises described and known as 5 Wells Road, Brookfield, Massachusetts described in said mortgage, to wit:
The land, with the buildings thereon, located at 176 Fiskdale Road, a/k/a 5 Wells Road, Brookfield, Worcester County, Massachusetts, shown as Parcel 2 on Plan recorded in the Worcester District Registry of Deeds in Plan Book 701, Plan 62, being further bounded and described as follows: BEGINNING at an iron pin on the Easterly line of Fiskdale Road at the Southwest corner of land now or formerly of Wendy A. DiPilato; THENCE Southerly along a curve having a radius of 100 feet a distance of 43.96 feet along said road to a bound; THENCE Southerly along a curve of Fiskdale Road having a radius of 1,970 feet a distance of 342.17 feet to a bound; THENCE S. 3° 46' 48" E. 237.94 feet along the Easterly line of Fiskdale Road to a bound; THENCE Southerly along the Easterly line of Fiskdale Road along a curve having a radius of 4,030 feet a distance of 500.06 feet to a bound at the Easterly side of Fiskdale Road and the Northerly line of Wells Road; THENCE along a curve having a radius of 20 feet a distance of 48.77 feet along Wells Road; THENCE N. 36° 44' 12" E. 93.98 feet along Wells Road; THENCE N. 3° 54' 42" E. 537.99 feet along Wells Road; THENCE N. 00° 46' 22" E. 150.35 feet along Wells Road; THENCE 5° 16' 44" E. 185.52 feet along Wells Road; THENCE N. 14° 16' 44" E. 93.37 feet along Wells Road to an iron pin at the Southeasterly corner of land now or formerly of said DiPilato; THENCE N. 59° 34' 51" W. 192.48 feet to an iron pin at the place of beginning. Said parcel containing 3.163 acres more or less.
The Mortgagee reserves the right to postpone the sale to a later date by public proclamation at the time and date appointed for the sale and to further postpone at any adjourned sale date by public proclamation at the time and date appointed for the adjourned sale date. The Mortgagee further reserves the right to open the bidding at the time, date and place appointed for sale, and if no bids are received, or the bids received are deemed unacceptable to Mortgagee, to postpone the sale to a later date by public proclamation.
Said premises will be sold subject to and with the benefit of all restrictions, easements, improvements, outstanding tax titles, mortgages, liens, rights of tenants and parties in possession, unpaid taxes, municipal liens and other public taxes, assessments or liens, having priority over the mortgage described herein, if any.
In the event that the successful bidder at the foreclosure sale shall default in purchasing the within described property according to the terms of this Notice of Sale and/or the terms of the Memorandum of Sale executed at the time of the foreclosure, the Mortgagee reserves the right to sell the property by Foreclosure Deed to the second highest bidder provided that the second highest bidder shall deposit with Mortgagee's attorneys the amount of the required deposit as set forth herein within three (3) business days after written notice of default of the previous highest bidder and title shall be conveyed to said second highest bidder within twenty (20) days of said written notice.
TERMS OF SALE: Ten Thousand Dollars ($10,000.00) will be required to bid and be paid in cash or by certified check at the time and place of sale as earnest money. The balance is to be paid in cash or by certified check within thirty (30) days of the date of the sale at the Law Office of Michael J. Murphy, 5 Commonwealth Road, Natick, Massachusetts 01760. The description of the premises contained in said mortgage shall control in the event of any typographical error in this publication.
