MORTGAGEE'S SALE OF REAL ESTATE By virtue of and in execution of the Power of Sale contained in a certain mortgage given by: David W. Clark and Stacey C. Clark to The Cape Cod Five Cents Savings Bank, dated December 17, 2020, recorded with the Barnstable County Registry of Deeds at Book 33601, Page 51 on December 22, 2020, of which mortgage the undersigned is the present holder, for breach of conditions of said mortgage and for the purpose of foreclosing the same will be sold at public auction at 12:00 o'clock noon on the 8th day of July, 2026, at 85 Great Oak Road, (East) Orleans, Barnstable County, Massachusetts , all and singular the premises described in said mortgage as follows: shown as a parcel of land containing 1.766 acres, more or less, on a plan of land recorded at Plan Book 160, Page 113, located in (East) Orleans, Barnstable County, Commonwealth of Massachusetts. For title, see Deed recorded at the Barnstable County Registry of Deeds at Book 28668, Page 316. TERMS OF SALE: The premises will be sold subject to and with the benefit of all rights, covenants, easements, conditions, restrictions, unpaid taxes, tax titles, water bills, municipal liens and/or assessments, rights of tenants and parties in possession, existing encumbrances of record created prior to the mortgage and rights of redemption which survive the foreclosure sale, if any. Ten Thousand and 00/100 ($10,000.00) Dollars will be required to be paid in cash or by certified check, or by bank cashier's check, by the purchaser at the time and place of sale as earnest money.
