This action will create approximately 1.64 acres (71,438 square feet) of disturbances to the regulated 100-foot adjacent area of a Class II NYS Freshwater Wetland, associated with the construction of two buildings, access roads, stormwater retention structures, and grading. This project was previously permitted in 2015, with a modification to the project permitted in 2022. The previous permit expired in 2025 and no additional modifications to the previously permitted plans have been made. State Environmental Quality Review (SEQR) Determination Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other involved agencies was performed and a Negative Declaration is on file. SEQR Lead Agency Wallkill Town Planning Board State Historic Preservation Act (SHPA) Determination A cultural resources survey has been completed. The report of the survey is on file. No archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required. DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29) It has been determined that the proposed action is not subject to CP-29.
