Notice of an Approved Administrative Settlement Pursuant to 42 U.S.C. § 9613(f)
Brownfield redevelopment of 0 Stephens Road, Columbia, Maury County, Tennessee 38401, known as Stephens Road Property - (Parcel 's 063 025.05; 063 025.06; 063 025.07) (Site), TDEC DoR Site # 60567
The Division of Remediation ("DoR") has accepted into its Brownfield Program an approximate 15.56-acre parcel of property to facilitate redevelopment of the Site by the McEwen Group (the "Voluntary Party"). The Brownfield Voluntary Agreement ("Agreement") between the Voluntary Party and DoR includes liability protection for the Voluntary Party and any successor parties, including protection against third-party contribution claims regarding matters identified and addressed in the Agreement. This notice serves the dual purpose of notice of the terms of the Agreement to the public and to third parties who may hold contribution claims under 42 U.S.C. § 9613 (f).
The Site is approximately 15.56 acres in size and features mostly vacant land with pasture, woods, and one small farm building on Lot 1. The Site was formerly owned and operated by Monsanto Chemical Company. The Site was used for process of phosphates and mining through open pit mines. The operational history resulted in stability issues and generation and placement of contamination at many of these properties, therefore a Notice of Land Use Restriction (NLUR) was placed on all the properties. The subject property has been evaluated through historical review, soil and groundwater sampling and analysis and reviewed by TDEC DOR indicating soil removal should not pose a danger to public health, safety, and the environment based on these findings. The DoR acknowledges that the Site has been impacted by historical operations.
Soil is known to be contaminated with several metals that exceed the EPA Region 4 Regional Screening Levels (RSLs) for residential land use. The metals are arsenic, chromium, and total phosphate; however, these metals can also be found in naturally occurring concentrations in exceedance of the RSLs in Tennessee.
Groundwater sampled and analyzed resulted in the following chemicals of potential concern (COPCs). The COPCs were identified above the reported detection limit (RDL) and below the maximum contaminant levels (MCLs) for drinking water for those COPCs with MCLs.
Metals detected in groundwater (total and dissolved) – COPCs barium, chromium, and lead were detected in groundwater below drinking water maximum contaminant levels (MCLs). Fluoride and total phosphorus were also detected, however there are no drinking water MCLs for these COPCs. Fluoride, naturally occurring in groundwater (wells) may vary in concentration from 0.1 mg/L to >10 mg/L. Total phosphorus is slightly above the level of 0.1 mg/L that may impact water quality in the form of provision of nutrients for algal blooms in surface waters.
Volatiles/Semi-volatile (VOCs/SVOCs) detected in groundwater – COPCs perchlorate (slightly above detection in only one sample), acetone, bis(2-ethylhexylphthalate), di-n-butyl phthalate, acetone, 2 Butanone (MEK), and toluene were detected in groundwater. These COPCs in groundwater samples are low in concentration and some are typical laboratory contaminants.
Metals, Volatiles, and Semi-volatile COPC concentrations in groundwater analyzed are not indicative of a significant mining operation or release impacting groundwater at the subject property.
The Voluntary Party proposes to use the subject property for residential use.
The Site has been the subject of environmental investigations, the results of which have been reviewed by DoR. All reports of the investigation and remediation of the Site are on file with the DoR. These investigations concluded that the Site has been impacted by real or perceived hazardous substances, solid waste or other pollutants determined to be present in this Site relating to the historical operations at the site and/or at neighboring properties. Due to the presence of these constituents, a Soil Management Plan (SMP) is prepared and will be followed during development activities that will include excavation and usage of 2' feet of soil cap beneath buildings. There will be a filter placed on the water well installed. These and other measures required by DoR under the Agreement for the Site will ensure protection of human health and the environment.
