NOTICE OF DECISION
CITY OF ELIZABETH BOARD OF ADJUSTMENT
UNION COUNTY, NEW JERSEY
PLEASE TAKE NOTICE that the City of Elizabeth Zoning Board of Adjustment ("Board") did on September 11, 2025 adopt a resolution of approval of an application made by IMMACULATE CONCEPTION CHURCH ("Applicant") for variance approval to construct an approximately 2,006 s.f. office addition to the existing church and other associated site improvements on property located at 417 Union Avenue, Elizabeth, NJ and designated as Block 151, Lot 1.02 on the City of Elizabeth Tax Map ("Property"). The Property is located in the OC-2 Office Commercial-2 and R-3 Residential zones and consists of approximately 2.12 acres. Applicant was granted variance relief from Ordinance §17.36-170(C)(2) that requires a side yard setback of 15.8 ft. where approximately 13.25 ft. is proposed, Ordinance §17.36-170(C)(6) that requires 20% open space where approximately 8.52% open space is proposed and approximately 10.96% currently exists, Ordinance §17.36-170(C)(7) that permits an impervious coverage of 75% where approximately 92.92% is proposed and approximately 90.49% currently exists, Ordinance §17.40-040(A)(Table I) that requires 150 off-street parking spaces where 118 off-street parking spaces are proposed, Ordinance §17.36-170(C)(2) that requires a rear yard building setback of 10.9 ft. and a rear yard setback of approximately 2.9 ft. is proposed and existing, and N.J.S.A 40:55D-70(d)(2) and Ordinance §17.36.170 to permit the expansion of a pre-existing non-conforming religious use.
