NOTICE OF DECISION
Pursuant to NJSA 40:55D-10(i)
PLEASE TAKE NOTICE that the Zoning Board of Adjustment of the Township of Ocean ("Board") did, on the 19th day of February, 2026, formally adopt a Resolution memorializing the action of the Board taken at its meeting of December 22, 2025, granting WF Ocean Redevelopment LLC ("Applicant") approvals with regard to property known as Lot 4 in Block 34 as shown on the Official Tax Map of the Township of Ocean and located at 1600 New Jersey State Highway Route 35 ("NJSH 35"), Ocean Township, New Jersey ("Property"). The Property is a corner lot with frontage on both NJSH 35 and Deal Road, and currently contains a one-story, 8,253 square-foot Wells Fargo bank with a four-lane, full service drive-thru, associated parking, and related site improvements.
The Board granted Applicant the following approvals:
Preliminary and final major site plan approval to demolish the existing building and construct a new 3,530 square foot Wells Fargo bank with a one-lane, ATM-only drive-thru ("Wells Fargo" and a 2,083 square foot Dunkin' fast food restaurant with drive-thru ("Dunkin"), along with associated site improvements including but not limited to parking, grading and drainage, landscaping, signage, and lighting. As part of the approval, a right-of-way dedication will be granted to the Township along the Deal Road frontage.Use variance relief pursuant to NJSA 40:55D-70.d.1 to permit two principal uses on one lot, whereas only one principal use per lot is permitted in the C-2 Zone in which the Property is located.Conditional use variance relief pursuant to NJSA 40:55D-70.d.3 to permit a drive-in/fast-food eating establishment on a lot shared with another use, rather than on a free-standing lot or as part of a larger shopping center.Bulk variance relief pursuant to NJSA 40:55D-70.c as follows:Lot area of 1.28 acres, whereas a minimum of 2 acres is required.Lot width of 242 feet, whereas a minimum of 250 feet is required.Front yard setbacks of 69 feet on Deal Road and 87 feet on NJSH 35, whereas a minimum of 100 feet is required.Lot depth of 230 feet, whereas a minimum of 250 feet is required.Freestanding sign setback of 4 feet on NJSH 35 and 5 feet on Deal Road, whereas a minimum of 15 feet is required.Four (4) building mounted signs for Wells Fargo and three (3) building mounted signs for Dunkin', whereas a maximum of one (1) sign per street frontage for each business is permitted.Number, height, location, and area of internal directional signs.Parking space width of 9 feet, whereas a minimum of 10 feet is required.Parking space setbacks of 6 feet to Deal Road and 18 feet to NJSH 35, whereas a minimum of 25 feet is required.One way traffic aisle width of 12 feet, whereas a minimum of 13 feet is required.Two (2) curb cuts which are not in the center 1/3 of the lot, whereas a maximum of one (1) curb cut located in the center 1/3 of the lot is permitted.No loading space provided for Dunkin', whereas a minimum of 1 loading space is required.Total landscaped area of 23.81%, whereas a minimum of 25% is required. Front yard landscaped areas of 25.9% (Deal Road) and 24.2% (NJSH 35), whereas a minimum of 30% is required.Front yard landscaped area widths of 7 feet (Deal Road) and 18 feet (NJSH 35), whereas a minimum of 25 feet is required.Side and rear yard landscaped areas of 5 feet (northern) and 6 feet (western), whereas a minimum of 10 feet is required.Landscaping proposed within 10 feet of the right-of-way line, whereas no landscaping other than grass is permitted within 10 feet of the right-of-way line.Design waiver pursuant to NJSA 40:55D-51 for lack of required street tree spacing.
