NOTICE OF DECISION
Pursuant to NJSA 40:55D-10(i)
PLEASE TAKE NOTICE that the Zoning Board of Adjustment of the Borough of Belmar ("Board") did, on the 25th day of June, 2026, formally adopt a Resolution memorializing the action of the Board taken at its May 28, 2026 meeting granting Melinda Basaran ("Applicant") approvals with regard to property known as Lot 1 in Block 190 as shown on the Official Tax Map of the Borough of Belmar and located at 1900 Ocean Avenue, Belmar, New Jersey ("Property"). The Property is as corner lot with frontages on Ocean Avenue and Nineteenth Avenue.
The Property currently contains a preexisting nonconforming 2-story, 2-family dwelling with a habitable basement, freestanding garage, and related site improvements. The approval permits renovations to and construction of additions to the existing building including reconfiguring interior space, converting the basement into a non-habitable crawl space, and adding a partial third-floor with access to a roof deck. The approval additionally permits renovation of the existing freestanding garage including an addition of a non-habitable attic addition for storage only, as well as related site improvements.
In conjunction with the approval, the Board granted the following relief:
Use variance relief pursuant to N.J.S.A. 40:55D-70.d.2 to permit the expansion of the preexisting nonconforming 2-family structure/use.
Floor Area Ratio variance relief pursuant to N.J.S.A. 40:55D-70.d.4 to permit a floor area ratio of 67.4%, whereas a maximum of 65% is permitted.
Bulk variance relief pursuant to N.J.S.A. 40:55D-70.c for: Front yard setbacks to principal building of 19.66 feet (Nineteenth Avenue) and 19.81 feet (Ocean Avenue), whereas a minimum of 20 feet is required for each. Rear yard setback to principal building of 23.91 feet, whereas a minimum of 35 feet is required. Side yard (south) setback to principal building of 3.9 feet, whereas a minimum of 5 feet is required. Principal building setback to garage of 6.27 feet, whereas a minimum of 10 feet is required. Principal building height of 3 stories, whereas a maximum of 2 stories is permitted. Garage building height of 2 stories, whereas a maximum of 1 story is permitted. Building coverage (buildings and roofed areas) of 44.5%, whereas a maximum of 30% is permitted. Two (2) off-street parking spaces provided, whereas 4 off-street parking spaces are required.
