Notice of Final Agency Action by the Florida Department of Environmental Protection (FDEP) Notice is given that FDEP's Final Agency Action of September 19, 2025 issues Environmental Resource Permit Number 55-0456279-001-EI to the Florida Department of Transportation District 2 for its project, which proposes to replace the existing St. Augustine seawall from immediately south of the Bridge of Lions to the Castillo de San Marcos National Monument; and improve the promenade and drainage in the area. The Project is in St. Johns County, Section 4, Township 7 South, Range 30 East. The file pertaining to the Project is available for inspection Monday through Friday except for legal holidays, 8:00 a.m. to 5:00 p.m. at FDEP's Northeast District Office, 8800 Baymeadows Way West, Suite 100 Jacksonville, Florida 32256. A person whose substantial interests are affected by FDEP's permitting decision may petition for an administrative hearing by filing a written petition with FDEP in accordance with Sections 120.569 and 120.57, Florida Statutes (F.S.). The petition must contain the information in Chapters 28-106 and 62-110, Florida Administrative Code (F.A.C.) and be filed (received by the Clerk) in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, or via electronic correspondence at Agency_Clerk@dep.state.fl.us. Petitions must be filed within twenty-one (21) days of publication of this notice or receipt of written notice, whichever occurs first. A copy of the petition shall be mailed to the applicant at the time of filing. The failure to file a petition for an administrative hearing within the appropriate time frame shall constitute a waiver of the right to request an administrative hearing or to intervene in this proceeding and participate as a party to it.
