You and each of you are hereby notified:
1) The written contract dated September 10, 2021 and filed September 13, 2021 as Book 18747, Page 920 in the records of the POLK County Recorder's Office, and executed by Kenneth G. Mylon and Carmen M. Mylon, husband and wife, as Seller, and Miguel Alejo-Rubio and Griselda Rubio-Pascual, husband and wife, as Buyer(s) ("the Real Estate Contract") for the sale of following legally described real estate: Lot 5 in Aalbers Acres, Final Plat, an Official Plat, Polk County, Iowa.
locally known as 6893 NE RISING SUN DRIVE, PLEASANT HILL, IA 50327 (the "Property"), with the Seller's interest presently held by Contract Exchange Corporation and the Buyer's interest presently held by Miguel Alejo-Rubio and Griselda Rubio-Pascual, husband and wife,
has not been complied with in the following particulars:
Unpaid Installments (5 x $2,390.84 beginning with the payment due on 02/15/2026) $11,954.20
Late Charges owing for above or unpaid $2,667.52
Unpaid Charges for funds advanced by Seller $1,310.11
Cost of Service and Clerical preparation $150.00
Less amounts held in Buyer's Reserve $0.00
TOTAL: $16,081.83
2) The Real Estate Contract shall stand forfeited unless the parties in default, within 30 days after the completed service of this notice, shall perform the terms and conditions in default, and in
addition pay the reasonable costs of serving this notice.
3) The amount of attorney fees claimed by the Seller pursuant to Section 656.7 of the Code of Iowa is $0.00 (not to exceed $50.00). Payment of the attorney fees is not required to comply with this notice in order to prevent forfeiture.
