NOTICE OF FORFEITURE OF OIL AND GAS LEASE
(Ohio Revised Code § 5301.332)
To: Ervin Morris dba Chris Oil Company (last known address P.O. Box 255, Byesville, Ohio 43723), Moran Oil Partners, LLC (last known address 22031 Clutter Road, Utica, Ohio 43080), Tri-State Petroleum, Inc. (last known address 9714 Montgomery Road, Cincinnati, Ohio 45242)
J E Fisher Farm, LLC is the owner of certain property located in Licking County, Ohio, Parcel Numbers 033-103488-00.000 and 033-103494-00.000, which property is more fully described in the Quit-Claim Deed executed June 30, 2023, and recorded July 21, 2023, Licking County Recorder, Instrument ID 202307250013114 (the "Premises").
Upon information and belief, J E Fisher Farm, LLC is the successor lessor ("Lessor") of a certain oil and gas lease from Carl W. Fisher and Feral M. Fisher, husband and wife, to Tri-State Petroleum, Inc., dated December 16, 1970, and recorded in Volume 124, Page 329 of the Licking County Lease Records; which covers 160 acres, more or less (the "Lease").
Our records search indicates that Ervin Morris dba Chris Oil Company, Moran Oil Partners, LLC, and Tri-State Petroleum, Inc. may be successor lessees ("Lessee") of said Lease.
The Lease was in effect for a primary term of ten (10) years and "as long thereafter as oil, gas, casinghead gas, casinghead [indecipherable], or any of them is produced from said leased premises…"
This is to provide notice under Ohio Revised Code § 5301.332 that J E Fisher Farm, LLC considers the Lease to be forfeited and void due to the following:
(a) Lessees have failed and neglected to comply with specifically described covenants provided for in the Lease (i.e., have failed to make required payments, including, but not limited to, royalty payments); and/or
(b) The term of the Lease has expired as there are currently no producing oil and/or gas wells on the Premises or lands pooled or unitized therewith which pertain to the Lease.
This serves as formal notice that J E Fisher Farm, LLC intends to file for record an Affidavit of Forfeiture with the Licking County Recorder if you do not have your interest in the Lease released of record within thirty (30) days from the publication of this notice.
