NOTICE OF FORFEITURE OF REAL ESTATE CONTRACT
TO: PROFESSIONAL PAINTING BY SANDY MILLER, LLC c/o Registered Agent, Sandy Miller, 3148 S. 12th Ave W, Newton, IA 50208 and Parties in possession, 100 Brown Street, Runnells, IA 50237
You and each of you are hereby notified:
The written contract dated March 29, 2023, and executed by TBRG Investment Properties, LLC as vendors, and PROFESSIONAL PAINTING BY SANDY MILLER, LLC, as vendees, recorded on August 31, 2022; in the office of the Polk County Recorder, recorded in Book 19249 and Page 864, for the sale of the following described real estate:
The South 26 feet of Lot 5 in Block 1 in the Town of Runnells, Polk County, Iowa.
has not been complied with in the following particulars:
a) Balloon Payment on July 1, 2025 $120,463.55
b) Interest from Balloon Date $2,080.88
Total: $122,544.43
2. The contract shall stand forfeited unless the parties in default, within 30 days after the completed service of this notice, shall perform the terms and conditions in default, and in addition pay the reasonable costs of serving this notice.
3. The amount of attorney fees claimed by the Vendors pursuant to Section 656.7 of the Code of Iowa is $50.00 (not to exceed $50.00). Payment of the attorney fees is not required to comply with this notice in order to prevent forfeiture.
