NOTICE OF INTENT TO ISSUE A PLAN APPROVAL
Notice is hereby given in accordance with 25 Pa. Code Sections 127.44(b) and 127.424(b) that the Dept. of Environmental Protection (DEP) intends to issue a revised Plan Approval to WM Renewable Energy, LLC. This revised Plan Approval reflects an increase in emissions of PM and SOx at a new renewable natural gas (RNG) facility located in Falls Township, Bucks County. This Plan Approval will subsequently be incorporated into a Title V Operating Permit in accordance with 25 Pa. Code Section 127.502.
Plan Approval application No. 09-0252A is a Plan Approval modification to Plan Approval No. 09-0252A, which was issued on August 3, 2023. This Plan Approval is for revisions to the PM and SOx emission limits applicable to the thermal oxidizers (Source IDs C150 and C151) associated with two (2) RNG plants (Source IDs 101 and 102), located in Falls Township, Bucks County. The RNG plants process landfill gas from the Fairless landfill, G.R.O.W.S. landfill, and Tullytown landfill, converting the landfill gas to pipeline quality natural gas, which is then directed to the nearby natural gas pipeline. As part of the process, there is a waste gas stream that is treated by the associated thermal oxidizers. During startup of the RNG plants and when processed landfill gas does not meet the required specs for pipeline natural gas, the landfill gas/off-spec gas is combusted using associated flares. There are no boilers, heaters, or generators currently at this site. The facility is a major facility for nitrogen oxides (NOx). In April 2025, the permittee performed stack testing on one of the thermal oxidizers, as per the requirements of the Plan Approval. The stack test revealed that PM emissions and SOx emissions were higher than expected. After investigating the results of the stack test, it was determined that there was a high amount of condensable PM in the PM emissions. There were also sulfur compounds that were not captured in earlier stages of the process, resulting in higher concentrations of sulfur in the tail gas. Revised sitewide potential emissions are as follows: NOx – 35.78 TPY; carbon monoxide (CO) – 69.98 TPY; volatile organic compounds (VOC) – 8.64 TPY; sulfur oxides (SOx) – 30.14 TPY (an increase of approximately 24 TPY); particulate matter (PM) – 16.88 TPY (an increase of approximately 12 TPY); PM-2.5 – 10.78 TPY; hydrogen chloride (HCl) - 6.24 TPY; and total hazardous air pollutants (HAP) – 7.14 TPY. The Plan Approval contains the necessary monitoring, recordkeeping, reporting, and work practice standards to keep the facility operating within all applicable air quality requirements.
Copies of the application, DEP's analysis, and other relevant information are available for public review at DEP's Southeast Regional Office, 2 East Main Street, Norristown, PA 19401. An appointment to review the documents may be scheduled by calling the Records Management Section of DEP's Southeast Regional Office at 484.250.5910 between 8:00 A.M. and 4:00 P.M., Monday through Friday, except holidays.

DEP may, in its discretion, hold a public hearing regarding the proposed Plan Approval if it decides that such a hearing is warranted based upon the comments, information, and objections received. All persons submitting comments, information, and/or objections, or otherwise requesting a hearing, will be notified of DEP's decision to hold a public hearing by publication in this newspaper and/or the Pennsylvania Bulletin, except when DEP determines that notification by telephone is sufficient.
