NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by 150 Old State Highway Cottages, LLC ("Borrower") to 1845 Blue Sky, LLC ("Mortgagee"), dated February 21, 2025 and recorded with the Barnstable County Registry of Deeds in Book 36839, Page 146, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 1:00 PM (ET) on the 11th day of December, 2025, on the mortgaged premises located at 150 Old State Highway, Eastham, Massachusetts 02642 all and singular the premises described in said mortgage.

The following described property is situated in the Town of Eastham, County of Barnstable and Commonwealth of Massachusetts:

The land in Eastham, Barnstable County, Massachusetts, together with the buildings thereon, bounded and described as follows:
Beginning at a point on the easterly side of State Highway Route 6;
Thence northeasterly by said Route 6 by a curve to the right having a radius of 1,172.67 feet, a distance of 316 feet, more or less, to a point:
Thence north 43°03'02" east by said Route 6, a distance of 147.34 feet, more or less to a point;
Thence north 50°04'23" east by said Route 61 a distance of 181 feet, more or less, to a point:
Thence south 73 ° east, approximately by land now or formerly of a distance of 68 feet, more or less, to the Town Cove;
Thence southerly by said Town Cove a distance of 480 feet, more or less, to a point;
Thence north 73° west, approximately by land now or formerly of Johanna S. Brooks, a distance of 320 feet, more or less, to the point of beginning.
Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. This is subject to Special Permit, Case No. ZBA 2025-02, issued by the Town of Eastham (Massachusetts) Zoning Board of Appeals dated May 7, 2025, and recorded at said Registry at Book 36963, Page 59.
Terms of sale: A deposit of $50,000 in certified funds as qualification to bid; high bidder will be required to deposit an amount equal to 10% of purchase price within five (5) days of auction end, which is non-refundable. Closing will be within 45 days of the auction. The Property will sell at reserved auction. Seller/Mortgagee has right to accept or reject the highest bid, bid on the property, postpone, cancel or participate as otherwise defined in notice of sale, terms of sale, mortgage or other terms. In the event of an error in this publication, the description of the premises contained in said mortgage shall control.
