NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Rui Silva to Bristol County Savings Bank dated April 16, 2021 and recorded in the Bristol County Southern District Land Court as Document Number 130245 on Certificate of Title Number 25532, of which mortgage Bristol County Savings Bank is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing, a portion of the same will be sold at Public Auction at 10:00 a.m. on December 11, 2025, on the mortgaged premises located at 861 B Ashley Boulevard, New Bedford, Bristol County, Massachusetts, all and singular the premises described in said mortgage,
TO WIT:
The land with the buildings thereon, known and numbered as 861-B Ashley Boulevard, situated in the City of New Bedford, Bristol County, Massachusetts, bounded and described as follows:
Westerly by Lowell Street, three hundred forty-three and 51/100 (343.51) feet;
Northerly by land now or formerly of Joseph Matesich et al, one hundred twenty-six and 71/100 (126.71) feet;
Easterly forty (40) feet, and
Northerly one hundred ten (110) feet by land now or formerly of Behzat Sivisoglu
Easterly by Ashley Boulevard, sixty-five and 20/100 (65.20) feet;
Southerly by land now or formerly of F.B. Thurston, et al, one hundred (110) feet;
Easterly by said land now or formerly of F.B. Thurston, et al and by land now or formerly of Roger Bourgeois, two hundred thirty-one and 05/100 (231.05) feet; and
Southerly by lands now or formerly of David E. Costa et al and of William Metcalf et al, one hundred seven and 05/100 (107.05) feet.
All of said boundaries are determined by the Court to be located as shown on plan 39508A, drawn by Garcia Engineering, Inc., Surveyors, dated January 11, 1977, as modified and approved by the Court, filed in the land Registration Office at Boston, a copy of a portion of which is filed in Bristol County (S.D.) Registry of Deeds, in Land Registration Book 70, Page 225 with Certificate of Title No. 13048, and shown thereon as Lots 1 and 2.
The land above described is subject to a sewer easement set forth in a taking by the City of New Bedford, dated May 13, 1954, duly recorded in Book 1117, Page 41.
For Grantor's title, see: (a) Instrument of Taking dated August 17, 2005 and filed with the Bristol County (South) Registry District of the Land Court as Document 94979, Certificate 21639, (b) Instrument of Assignment dated May 27, 2016 and filed with said Registry District as Document 119083, Certificate 21639, (c) Judgment in Tax Lien Case issued by the Massachusetts Land Court dated December 10, 2019 and filed with said Registry District as Document 126909, Certificate 21639, and (d) Land Court Order for Issuance of New Certificate After Judgment of Foreclosure dated November 30, 2020 and filed with said Registry District as Document 129275, Certificate 25401.
Subject to easements, restrictions, parties in possession and encumbrances of record, insofar as the same are in force and applicable, however, not intending to revive any of the same hereby. This conveyance does not create any new boundaries.
For title see deed recorded in Bristol County (S.D.) Land Court Document Number 130244 on Certificate of Title Number 25532.
This sale does not include Parcels 1, 2 and 3 on the Mortgage recorded in Bristol County S.D. Registry of Deeds Book 13765, Page 187.
These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
TERMS OF SALE
A deposit of Ten Thousand ($10,000.00) Dollars by cash, certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Vieira & DiGianfilippo Ltd., 480 Turnpike Street, South Easton, Massachusetts 02375, within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. The description of the premises contained in said mortgage shall control in the event of an error in this publication.
