NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by John J. Hartman and Amy H. Hartman to Mortgage Electronic Registration Systems, Inc., as nominee for Flagstar Bank, FSB, its successors and assigns dated January 31, 2007, recorded at the Plymouth County Registry of Deeds in Book 34053, Page 331; said mortgage was then assigned to CTF Asset Management, LLC by virtue of an assignment dated July 19, 2019, and recorded in Book 51386, Page 127; said mortgage was then assigned to MCLP Asset Company, Inc. by virtue of an assignment dated May 8, 2023, and recorded in Book 57971, Page 314; said mortgage was then assigned to U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for Legacy Mortgage Asset Trust 2021- SL2 by virtue of an assignment dated February 12, 2025, and recorded in Book 59754, Page 66; said mortgage was then assigned to Wilmington Savings Fund Society, FSB, not in its individual capacity but solely as Trustee of Arugula Funding Titling Trust by virtue of an assignment dated October 13, 2025, and recorded in Book 60536, Page 68; of which mortgage the undersigned is the present holder for breach of conditions of said mortgage and for the purpose of foreclosing the same will be sold at PUBLIC AUCTION at 11:00 AM on March 24, 2026, on the mortgaged premises. This property has the address of 61 Sproat Street, Middleboro, MA 02346. The entire mortgaged premises, all and singular, the premises as described in said mortgage:
A certain parcel of land, together with the buildings thereon, situated on the Northeasterly side of Sproat Street in Middleboro, Plymouth County, Massachusetts, bounded and described as follows:
Beginning at a stone in the Northeasterly sideline of Sproat Street, which marks the Southerly comer of land now or formerly of Ellen Sheehan, distant 132 feet Southerly from the Easterly comer of Oak and Sproat Streets; thence, Northeasterly at right angles with said Sproat Street and in line of lands now or formerly of Ellen Sheehan, John J. Creedon and Julia O'Donnell, 217 feet to land now or formerly of Rufus Carpenter, thence,
Southeasterly in said Carpenter's line, 49 feet to land now or formerly of Alpheus J. Carpenter, thence, continuing Southeasterly in said Alpheus J. Carpenter's line, 21.2 feet; thence Southwesterly parallel with the first described line and 80 feet distant therefrom, 208.40 feet to said Sproat Street; and thence, Northwesterly in line of said Street, 80 feet to the bound first mentioned.
Meaning and intending to convey the same premises conveyed to the herein named mortgagor(s) by deed recorded with Plymouth County Registry of Deeds in Book 34053, Page 318.
Subject to and with the benefit of easements, reservation, restrictions, and taking of record, if any, insofar as the same are now in force and applicable. In the event of any typographical error set forth herein in the legal description of the premises, the description as set forth and contained in the mortgage shall control by reference. Together with all the improvements now or hereafter erected on the property and all easements, rights, appurtenances, rents, royalties, mineral, oil and gas rights and profits, water rights and stock and all fixtures now or hereafter a part of the property. All replacements and additions shall also be covered by this sale.
Terms of Sale: Said premises will be sold subject to any and all unpaid taxes and assessments, tax sales, tax titles and other municipal liens and water or sewer liens and State or County transfer fees, if any there are, and TEN THOUSAND DOLLARS ($10,000.00) in cashier's or certified check will be required to be paid by the purchaser at the time and place of the sale as a deposit and the balance in cashier's or certified check will be due in thirty (30) days, at the offices of Doonan, Graves & Longoria, LLC ("DG&L"), time being of the essence.
