By virtue and in execution of the Power of Sale contained in a certain Commercial Mortgage Deed and Security Agreement and Collateral Assignment of Leases and Rents given by Hunter Russell and Melissa Byrnes to BRIRY, LLC dated April 27, 2023 and recorded with the Barnstable County Registry of Deeds (the "Registry") in Book 35756 at Page 158, of which mortgage the undersigned is the present holder, for breach of the conditions of said Commercial Mortgage Deed and Security Agreement and Collateral Assignment of Leases and Rents and for the purpose of foreclosing the same will be sold at Public Auction at 11 o'clock A.M. on the 3rd day of April, 2026 at 97 Polaris Drive, Mashpee, Massachusetts, all and singular the premises described in said mortgage,

The land and any buildings thereon located in Mashpee, Barnstable County, Massachusetts being shown as LOT 74 on a Plan of land entitled GREAT HAY ACRES' ZONING DISTRICT – R-3 SUBDIVISION PLAN OF LAND LOCATED IN MASHPEE- MASS. PREPARED FOR CLIPPER REALTY TRUST CAPE & ISLANDS SURVYEING INC. 131 SPRING BARS ROAD TEATICKET- MASS. And recorded with the Barnstable County Registry of Deeds in Plan Book 436, Page 46.
SUBJECT TO: Order of Taking by Town of Mashpee for Taurus Drive, Partial of Polaris Drive and Partial of Gemini Road dated February 13, 2012 and recorded March 6, 2012 at 8:43am in Book 26132 at Page 279, and in Plan Book 579 at Page 74.

Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
Terms of sale: A deposit of ten thousand dollars ($10,000) by certified or bank check will be required to be paid by the purchaser at the time and place of sale.
