NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Jill Batchelder and Michael Batchelder to Mortgage Electronic Registration Systems, Inc., as nominee for First Franklin, a Division of National City Bank dated August 31, 2006, recorded at the Middlesex County (Southern District) Registry of Deeds in Book 48097, Page 548, Confirmatory Mortgage recorded on July 7, 2009 in Book 53155, Page 226; said mortgage was then assigned to Wells Fargo Bank, National Association, as Trustee for the Holders of the First Franklin Mortgage Loan Trust 2006-FF15 Mortgage Pass-Through Certificates, Series 2006-FF15 by virtue of an assignment dated August 12, 2009, and recorded in Book 53429, Page 73, as affected by Corrective Assignment of Mortgage dated January 15, 2014 and recorded in Book 63224, Page 70; of which mortgage the undersigned is the present holder for breach of conditions of said mortgage and for the purpose of foreclosing the same will be sold at PUBLIC AUCTION at 11:00 AM on June 30, 2026, on the mortgaged premises. This property has the address of 73 Florence Avenue, Melrose, MA 02176. The entire mortgaged premises, all and singular, the premises as described in said mortgage:
The land with the buildings thereon situated on Florence Avenue, in Melrose, Middlesex County, Massachusetts, and being shown as Lot 41, on a plan of House Lots in Melrose, belonging to Allen C. Goss by Walter C. Stevens, C.E., March 1891, and recorded with Middlesex South District Deeds, in Plan Book 73, Plan 18. Said premises are further bounded and described as follows: Westerly by said Florence Avenue, fifty (50) feet; Northerly by Lot 39, on said plan, one hundred ten (110) feet; Easterly by Lot 40, on said plan, fifty (50) feet; Southerly by Lot 43, on said plan, one hundred ten (110) feet. Said premises contain 5500 square feet of land. This conveyance is made subject to easements, restrictions and mortgages on record in so far as the same are now in force and applicable. For title reference, see deed of Joanna L. Batchelder and Robert W. Batchelder dated August 31, 2006 and recorded in Middlesex County Southern District Registry of Deeds Book 48097, Page 546.
Subject to and with the benefit of easements, reservation, restrictions, and taking of record, if any, insofar as the same are now in force and applicable. In the event of any typographical error set forth herein in the legal description of the premises, the description as set forth and contained in the mortgage shall control by reference. Together with all the improvements now or hereafter erected on the property and all easements, rights, appurtenances, rents, royalties, mineral, oil and gas rights and profits, water rights and stock and all fixtures now or hereafter a part of the property. All replacements and additions shall also be covered by this sale.
Terms of Sale: Said premises will be sold subject to any and all unpaid taxes and assessments, tax sales, tax titles and other municipal liens and water or sewer liens and State or County transfer fees, if any there are, and TEN THOUSAND DOLLARS ($10,000.00) in cashier's or certified check will be required to be paid by the purchaser at the time and place of the sale as a deposit and the balance in cashier's or certified check will be due in thirty (30) days, at the offices of Doonan, Graves & Longoria, LLC ("DG&L"), time being of the essence.
