YOU AND EACH OF YOU ARE HEREBY NOTIFIED that Iowa State Bank has formally commenced a Non-Judicial Foreclosure of Non-Agricultural Mortgage pursuant to Iowa Code Chapter 655A due to defaults under the following: (1) Mortgage from Cecil L. Crawford and Verda E. Crawford, husband and wife, to Iowa State Bank, recorded March 23, 2004, in Book 10442, Page 843; (2) Mortgage from Cecil L. Crawford and Verda E. Crawford to Iowa State Bank, recorded June 27, 2007 in Book 12260, Page 126; (3) Mortgage from Cecil L. Crawford to Iowa State Bank, recorded March 23, 2016, in Book 15933, Page 516; (4) Mortgage from Cecil L. Crawford, a single person, recorded June 7, 2017, in Book 16512, Page 837; (5) Mortgage from Cecil L. Crawford, a single person, recorded June 7, 2017, in Book 16512, Page 821; (6) Promissory Note from Cecil L. Crawford to Iowa State Bank, dated May 30, 2017; (7) Payment Modification signed by Cecil Crawford to Iowa State Bank, dated August 6, 2017; and any modifications thereto.
Said Real Estate Mortgage is the first and paramount lien on the following-described real estate located in Polk County, Iowa, to-wit: Lot 8 in Cornell Heights, an Official Plat, now included in and forming a part of the City of Des Moines, Polk County, Iowa. (l/k/a: 2817 Cornell St., Des Moines, IA 50313) AND The North 50 feet of the South 255 feet of Lots 6, and 7, except the West 25 feet thereof, in BOWEN PLACE, an Official Plat, now included in and forming a part of the City of Des Moines, Polk County, Iowa. (l/k/a: 3937 Bowdoin St., Des Moines, Iowa 50313).
The original Mortgage Note in the amount of $69,000.00 is in default due to the death of the sole titleholder and borrower. Notice of Right to Cure was served upon Cecil L. Crawford, pursuant to 654.2D, Iowa Code (1987), and more than 30 days have elapsed, and the default has not been cured.
As of the date of this notice, the Borrower is indebted to the Lender for monies lent by Lender pursuant to the above-referenced Promissory Note in the amount of $46,579.57. Interest continues to accrue on the unpaid principal in the amount of $5.4236 per day from and after February 18, 2026. Further, Lender has expended certain sums as protective advancements against the above-described real estate.
Lender has advanced certain sums for attorney's fees, abstracting costs, recording fees, and protective advances. For the accurate sums of said attorney's fees and protective advances, you should contact Lender's representative as listed below.
That of all entities named herein, only Cecil L. Crawford is liable for the amounts set forth above. That all other remaining individuals and entities are named hereto because each particular individual and/or entity has or claims to have some interest, lien, right or title to the above-described real estate, junior and inferior to the mortgage lien in favor of Iowa State Bank.
You and each of you are hereby notified that, unless within 30 days after completed service of this Notice upon you, that the above amount is paid in full at the office of Melanie L. Jackson, Attorney at Law, Skinner & Paschke, PLLC, 1454 30th Street, Suite 102, West Des Moines, IA 50266, or a rejection of this Notice pursuant to Iowa Code Section 655A.6 is served upon Iowa State Bank, as Mortgagee, by serving its attorney, Melanie L. Jackson, Attorney at Law, Skinner & Paschke, PLLC, 1454 30th Street, Suite 102, West Des Moines, IA 50266, and filed with the Polk County Recorder, the Mortgages previously referenced will be foreclosed.
WITHIN THIRTY DAYS AFTER YOUR RECEIPT OF THIS NOTICE, YOU MUST EITHER CURE THE DEFAULTS DESCRIBED IN THIS NOTICE OR FILE WITH THE RECORDER OF THE COUNTY WHERE THE MORTGAGED PROPERTY IS LOCATED A REJECTION OF THIS NOTICE AND SERVE A COPY OF YOUR REJECTION ON THE MORTGAGEE IN THE MANNER PROVIDED IN SECTION 655A.4. IF YOU WISH TO REJECT THIS NOTICE, YOU SHOULD CONSULT AN ATTORNEY AS TO THE PROPER MANNER TO MAKE THE REJECTION.
IF YOU DO NOT TAKE EITHER OF THE ACTIONS DESCRIBED ABOVE WITHIN THE THIRTY (30) DAY PERIOD, THE FORECLOSURE WILL BE COMPLETE AND YOU WILL LOSE TITLE TO THE MORTGAGED PROPERTY. AFTER THE FORECLOSURE IS COMPLETE, THE DEBT SECURED BY THE MORTGAGED PROPERTY WILL BE EXTINGUISHED.
