NOTICE OF PUBLIC HEARING
Borough of Fairview Zoning Board of Adjustment
PLEASE TAKE NOTICE that the Borough of Fairview Zoning Board of Adjustment (the "Board") will hold a public hearing on November 20, 2025 at 7:00 PM at the Borough of Fairview Municipal Building, Council Chambers, located at 59 Anderson Avenue, Fairview, New Jersey 07022, to review and take formal action upon an application for preliminary and final major site plan approval along with use variance, bulk variance and design waiver/exception relief (the "Application") by Paul Juliano (the "Applicant") with respect to property having a street address of 28 Grant Street, Fairview, New Jersey and being designated as Block 219, Lot 17, on the Borough of Fairview Tax Map (the "Property"). The Property is located in the R-B Zoning District in the Borough of Farview.
The Applicant seeks approval to raze the existing site improvements and to construct a new three- (3) story, multi-family dwelling structure including four (4) dwelling units, on the Property. The Applicant also proposes related site improvements, including but not limited to, driveways, curbing and landscaping.
The Applicant seeks use variance approval pursuant to N.J.S.A. 40:55D-70(d)(1) for a multi-family dwelling where the same is not permitted.
The Applicant also seeks use variance approval pursuant to N.J.S.A. 40:55D-70(d)(5) for lot area per dwelling unit less than required (2,500 sf per dwelling unit required; 1,252.25 sf per dwelling unit proposed);
The Applicant also seeks use variance approval pursuant to N.J.S.A. 40:55D-70(d)(4) for floor area ration ("FAR") greater than permitted (.76 required; 1.026 proposed);
The Applicant further seeks bulk variances and design waiver/exception relief in connection with the application, including: (i) Building coverage greater than permitted (40% permitted; 49.08% proposed); (ii) Impervious coverage greater than permitted (65% permitted; 71.92% proposed); (iii) Projection of steps into the front yard or side yard greater than permitted (4 ft. in front yard or side yard permitted; 14 ft. & 15 ft. in the front yard proposed; 4 ft. 2 in. in the left side yard proposed; and 4 ft. 4 in. in the right side yard proposed); (iv) Side yard setback less than required (5 ft. (one) and 10 ft. (total) required; 4.5 ft. (one) and 9 ft. (total) proposed; and 3.33 ft. (left) and 3.33 ft. (right) proposed); and (v) Building height greater than permitted (30 ft. and 2.5 stories permitted; 31 ft. and 3 stories proposed).
The Applicant also seeks any additional deviations, exceptions, design waivers, submission waivers, variances, use variances, conditional use variances, interpretations, de minimis exceptions to the State of New Jersey Residential Site Improvement Standards, continuations of any pre-existing non-conforming conditions, modifications of prior imposed conditions and other approvals reflected on the filed plans (as same may be further amended or revised from time to time without further notice) and as may be determined to be necessary during the review and processing of the Application.
When this case is called, interested parties may appear, either in person or by attorney, and present any comments or questions which they may have regarding this Application. Formal action by the Board may be taken. The public hearing may be continued by the Board to a subsequent date or dates by way of public announcement made at the public hearing either with or without further published notice, as the Board may determine.
The Application and supporting materials (including maps and plans) will be available for public inspection, at least 10 days prior to the public hearing at the Office of the Borough Clerk, located at the Borough of Fairview Municipal Building, 59 Anderson Avenue, Fairview, New Jersey 07022, during regular business hours which are typically Monday through Friday between the hours of 8:00 am to 4:00 pm.
