Appeal of State Environmental Policy Act (SEPA)
Determination of Nonsignificance (DNS) for
City Ordinance No. 2025-21
You are hereby notified that the City of Bainbridge (City) Island Hearing Examiner will conduct an open record public hearing to consider the appeal described below pursuant to BIMC Chapter 2.16 Land Use Review Procedures, BIMC Chapter 16.04 Environmental Policy, and the Hearing Examiner's Rules of Procedure. You are invited to attend the hearing, but please be aware that public comments are not generally taken during appeal hearings.

Appeal Name: Janow Appeal of SEPA DNS for City Ordinance No. 2025-21
Proposal Description: City Ordinance No. 2025-21 amends BIMC Section 18.12.020 related to 100% affordable housing projects in the Ferry and Central Core zoning districts. The City is considering adding provisions to allow up to 0.5 floor area ratio (FAR) through the transfer of FAR for such projects. The City is also considering alternate standards for such affordable housing projects: to allow up to 3.0 FAR, increase allowed building height from 45 feet to 65 feet, and reduce parking requirements from 1 space to 0.5 spaces per dwelling unit.

Proposal Site: City Ordinance No. 2025-21 applies within the City's Ferry and Central Core zoning districts, east of State Route 305.
Appealed Action: The City, as SEPA lead agency, issued a DNS for Ordinance No. 2025-21 on September 5, 2025. Appellant Janow filed an appeal of said DNS on September 26, 2025, before the end of the appeal period.
