NOTICE OF PUBLIC HEARING
PLEASE TAKE NOTICE that the Planning Board of the City of Elizabeth, Union County, New Jersey (the "Planning Board"), will hold a public hearing on December 4, 2025, at 7:30 PM in the Municipal Building located at 50 Winfield Scott Plaza, Elizabeth, N.J. 07201 to investigate and determine whether all, or a portion, of the area hereinafter described meets the criteria for an area in need of condemnation redevelopment pursuant to N.J.S.A. 40A:12A-5 and should be designated as such an area in need of redevelopment, affording the municipality all options available under the law, excluding the power of condemnation.
The area in question consists of two parcels commonly known as 701-733 S. Front Street and 713-743 Amboy Ave, identified on the Tax Map of the City of Elizabeth, State of New Jersey (the "Study Area") as follows:

This public hearing is being held pursuant to the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1 et seq. as amended and supplemented (the "Redevelopment Law"), which authorizes municipal governing bodies to designate certain areas of the municipality as a condemnation area in need of redevelopment, which designation would permit the City to utilize all of the redevelopment powers prescribed by statute, excluding Eminent Domain pursuant to N.J.S.A. 40A:12A-8(c) (as designated, a "non-Condemnation Redevelopment Area"); and
PLEASE TAKE FURTHER NOTICE that you are entitled to be present at said public hearing to present any and all objections, or support, you may have, and any other general comments, relative to the Planning Board's investigation as to whether all, or a portion of, the Study Area should be designated as a non-Condemnation Redevelopment Area. The Resolution of the City Council authorizing and directing the Planning Board to undertake this preliminary investigation and make recommendations to the City Council (City Council Resolution dated September 9, 2025), the Planning Board's Resolution authorizing the preparation of a study for same (Planning Board Resolution dated October 16, 2025), the non-Condemnation Redevelopment Area investigation report, and a map depicting the boundaries of the proposed Redevelopment Area, along with a statement setting forth the basis for the investigation, are on file with the City Clerk and the Planning Board Clerk at the Municipal Building, 50 Winfield Scott Plaza, Elizabeth, N.J. 07201, and all are available for inspection during regular business hours.
PLEASE TAKE FURTHER NOTICE that, after review by the Planning Board at the hearing described herein, a finding by the City Council that the Study Area, or a portion thereof, constitutes a non-Condemnation Redevelopment Area, shall operate as a finding of public purpose, but shall not authorize the City/City Council to exercise the power of eminent domain to acquire property in the Study Area.
PLEASE TAKE FURTHER NOTICE that, if the City Council designates all, or a portion, of the Study Area as a non-Condemnation Redevelopment Area, owners of the designated property will receive a notice from the City notifying them of the designation and will have forty-five (45) days from the receipt of such notice to challenge the redevelopment designation by filing the appropriate action in the Superior Court of New Jersey, Law Division.
