NOTICE OF PUBLIC HEARING
ROCKAWAY TOWNSHIP ZONING BOARD OF ADJUSTMENT
MORRIS COUNTY, NEW JERSEY
To Whom It May Concern:
PLEASE TAKE NOTICE that DOUGLAS A. BROOKES, JR and KIMBERLY BROOKES (the "Applicants"), have filed a d-1 use variance application with the Rockaway Township Zoning Board of Adjustment for property known as Lot 39, Block 11301, commonly known as 554 Mt. Hope Avenue (the "Property"). The Rockaway Township zoning officer had previously issued a Notice of Violation claiming that the Property, which is located in the R-20 zone, is a two-family dwelling. Two-family dwellings are not permitted in the R-20 zone. The Applicant contends that the home as constructed is not a 2-family dwelling. The Applicant's immediate family are the only occupants of the dwelling. The Applicant contends the area above the garage is not a "separate" area which would qualify the space to be a two-family dwelling. However, should the Board interpret the construction of the previously constructed home to constitute a 2-family dwelling under the definition of "Two-Family Dwelling" set forth in Ordinance section 54-4.1c, then the Applicant will request a d-1 use variance to permit a two-family dwelling.
The application is now on the Zoning Board's agenda and a public hearing has been ordered for December 2, 2025, at 7:00 p.m. at the Rockaway Township Municipal Building, 65 Mount Hope Road, Rockway, New Jersey, at which time you may appear in person, with or without counsel, to be heard in connection with the application. The application documents are on file with the Board Secretary and are available for public inspection at least ten (10) days before the hearing at the Municipal Building during normal viewing business days (Monday through Friday) between the hours of 8:30 a.m. and 4:30 p.m., in the office of the Planning Department, 65 Mount Hope Road, Rockaway, New Jersey, for anyone interested in viewing the plans in advance of the hearing.
