NOTICE OF PUBLIC HEARING
Notice is hereby given of a public hearing to be held by the Board of County Commissioners (the "Board") of Lee County, Florida (the "County") on May 19, 2026, at 9:30 a.m. or as soon thereafter as the matter can be heard, in the Commission Chambers, 2120 Main Street, Fort Myers, FL 33901, to satisfy the requirements of Section 147(f) of the Internal Revenue Code of 1986, as amended (the "Code"), for the purpose of receiving comments and hearing discussion concerning the application of the proceeds of the Public Finance Authority Air Cargo Obligated Group Revenue Bonds (AFCO Airport Real Estate Group), Series 2023 (the "Bonds"), a portion of which in an aggregate principal amount of $9,700,000 will be applied to finance a portion of certain airport facilities described in Section 142(a)(1) of the Code located at the Southwest Florida International Airport at 15050 Service Road, Ft. Myers, FL 33913 (the "Project").
The Project is owned by the Lee County Port Authority and operated by AFCO Cargo RSW, LLC ("AFCO RSW"). The County is holding the hearing as an accommodation to the Public Finance Authority and AFCO RSW.
All interested persons are invited to attend said hearing and, either personally or through their representatives, to present oral or written comments and discussion concerning the proposed Project. Written comments may be submitted to the Lee County Clerk of Court, P.O. Box 2469, Fort Myers, Florida 33902, Attention: Kevin C. Karnes. In accordance with the Americans with Disabilities Act, persons needing a special accommodation or an interpreter to participate in this proceeding should contact the County at (239) 538-8782 at least five days (5) days in advance to request such accommodations. Any person deciding to appeal any decision made by the County after the hearing will need to ensure that a verbatim record of the proceeding is made, which record includes the testimony and evidence upon which the appeal is to be based.
The public hearing is required by Section 147(f) of the Code. Subsequent to the public hearing, the Board will consider whether to approve the application of the proceeds of the Bonds to finance the Project, as required by, and solely for the purposes of, Section 147(f) of the Code. The Bonds are not an obligation of the County and will not pledge the full faith and credit or the taxing power of the County but will be payable exclusively from revenues of AFCO RSW. Any person interested in the allocation of the proceeds of the Bonds or the location or nature of the Project may appear and be heard.
