NOTICE OF PUBLIC HEARING
TOWNSHIP OF WINSLOW
ORDINANCE OF THE TOWNSHIP OF WINSLOW, COUNTY OF CAMDEN,
AND STATE OF NEW JERSEY, AMENDING, SUPPLEMENTING, AND REVISING CHAPTER 199 OF THE CODE OF THE TOWNSHIP OF WINSLOW ENTITLED
"PEDDLING AND SOLICITING"
WHEREAS, the Township of Winslow ("Township") is a municipal entity organized and existing under the laws of the State of New Jersey and located in Camden County; and
WHEREAS, N.J.S.A. 53:1-20.38, et seq., establishes certain regulations and restrictions regarding a municipality's authority to regulate the licensing of peddlers and solicitors; and
WHEREAS, pursuant to N.J.S.A. 40:52-2, the governing body may fix the fees for all such licenses, which may be imposed for revenue, and may prohibit all unlicensed persons and places and vehicles, businesses and occupations from acting, being used, conducted or carried on; and
WHEREAS, pursuant to N.J.S.A. 40:48-2, the Governing Body is authorized to enact and amend ordinances as deemed necessary for the preservation of the public health, safety and welfare and as may be necessary to carry into effect the powers and duties conferred and imposed upon the Township by law.
NOW, THEREFORE, be it Ordained by the Mayor and Township Committee of the Township of Winslow, County of Camden, State of New Jersey, as follows:
SECTION 1. Chapter 199 of the Code of the Township of Winslow, entitled "Peddling and Soliciting" Section 2, entitled "Definitions," is hereby amended, revised and/or supplemented to include the following definition:
§199-2 Definitions.
MOBILE FOOD TRUCK VENDORS
A mobile food truck vendor is anyone who sells food or beverages from a vehicle such as a truck, van, or pushcart, whether such food or beverages are prepared on-site or prepared elsewhere and transported to the site of the sale. Includes any movable restaurant or retail food establishment in or on which food or beverages are transported, stored, or prepared for retail sale or given away at temporary locations. Note: This term does not apply to mobile caterers who are engaged in the business of transporting, in motor vehicles, food and beverages to residential, business, and industrial establishments pursuant to prearranged schedules and dispensing from the vehicles the items to and for the convenience of the personnel or occupants of such establishments.
SECTION 2. Chapter 199 of the Code of the Township of Winslow, entitled "Peddling and Soliciting" Section 5 entitled, "License Fee," is hereby amended, revised and/or supplemented to read as follows:
§199-5 License fee.
License fees for licenses as detailed in this Chapter are as follows:
(1) - (4) [NO CHANGE]
(5) Mobile Food Truck Vendors: Vendor/business: $200; Each additional vehicle: $50; Each additional driver: $25.
SECTION 3. Except as set forth in Sections 1 and 2 above, the balance of Chapter 199 shall not be affected by this Ordinance
SECTION 4. All Ordinances or parts of Ordinances inconsistent with this Ordinance are hereby repealed as to such inconsistency.
SECTION 5. If the provisions of any section, subsection, paragraph, subdivision, or clause of this Ordinance shall be judged invalid by a court of competent jurisdiction, such order of judgment shall not affect or invalidate the remainder of any section, subsection, paragraph, subdivision, or clause of this Ordinance.
SECTION 6. This Ordinance shall take effect immediately upon adoption and publication as required by law.
Notice is hereby given that the foregoing Ordinance was introduced and passed upon first reading at a regular meeting of the Mayor and Township Committee of the Township of Winslow on the 23rd day of September, 2025 , at 7:00 P.M., and the same was then ordered published according to law; and the same ordinance will be further considered for final passage during a meeting of the Mayor and Township Committee of the Township of Winslow to be held in the Mayor Dominic Maiese Municipal Complex, 125 S. Route 73, Braddock, New Jersey on October 14, 2025, commencing at 7:00 P.M., prevailing time, or at any time and place to which such meeting from time to time may be adjourned. All persons interested will be given an opportunity during said time to be heard concerning such Ordinance by order of the Mayor and Township Committee.
