NOTICE OF RESOLUTION NO. 26-34
Notice is hereby given that on the 22nd day of June 2026, the Village Board of the Village of Hales Corners adopted a Final Resolution 26-34, authorizing the construction of public improvements and levying special assessments against benefited properties.

FINAL RESOLUTION DIRECTING INSTALLATION OF, PAYMENT, AND LEVY OF SPECIAL ASSESSMENT FOR INSTALLATION OF A WATER DISTRIBUTION SYSTEM CONSISTING OF HYDRANTS, WATER MAINS AND LATERALS IN THE HALES HAPPINESS SUBDIVISION AND ROAD REHABILITATION OF 116th STREET, 110th STREET, 113th STREET AND COPELAND AVENUE AS REQUIRED FOR INSTALLATION OF THE WATER DISTRIBUTION SYSTEM
WHEREAS, the installation of a water distribution system public improvement inclusive of hydrants, water mains and laterals in the Hales Happiness Subdivision and road rehabilitation of 116th Street, 110th Street, 113th Street and Copeland Avenue as required for installation of the water distribution system is deemed necessary in the interest of public health, safety, and welfare, and will benefit abutting property owners; and
WHEREAS, the Village Board has declared its intent to exercise its police powers under Section 354-24 of the Village of Hales Corners Municipal Code and Sections 66.0703 and 66.0715 of the Wisconsin Statutes, determining that this public improvement project is necessary for the well-being of the public and affected property owners; and
WHEREAS, the Village Engineer has prepared and filed a special assessment report, which includes plans and specifications, an estimate of total project costs, and the proposed assessment for each affected parcel, and such report has been made available for public inspection in the Office of the Village Administrator/Clerk/Treasurer; and
WHEREAS, the Village Administrator/Clerk/Treasurer provided notice to affected property owners by mail on June 1, 2026, and published a notice in the official newspaper on May 27, 2026, pursuant to legal requirements, informing them of the proposed assessments and the opportunity to provide input; and
WHEREAS, a public hearing was held on June 22, 2026, at which time the Village Board heard comments from all persons who wished to speak.
NOW, THEREFORE BE IT RESOLVED, by the Village Board of the Village of Hales Corners, Wisconsin, as follows:
1. The work and improvements for the installation of a water distribution system public improvement inclusive of hydrants, water mains and laterals in the Hales Happiness Subdivision and road rehabilitation of 116th Street, 110th Street, 113th Street and Copeland Avenue are directed to be carried out.
2. The Village Engineer's Report, including plans and specifications, cost estimates, and special assessment allocations, is hereby approved, and the project shall proceed in accordance with the report.
3. Payment for the improvement shall be made by assessing the cost to the abutting properties as outlined by the Village Engineer's Report. Assessments may be paid in one (1) payment or in ten (10) annual installments, with an interest rate of 2.5% per annum to the Village Treasurer.
4. Any unpaid special assessments shall be placed upon the tax roll as a delinquent tax, in accordance with Section 66.07001 of the Wisconsin Statutes.
5. The Village Administrator/Clerk/Treasurer is directed to publish this resolution as a Class I notice under Chapter 985 of the Wisconsin Statutes and to mail a copy of this Resolution to every property owner whose name appears on the assessment roll and whose post office address is known or can be ascertained with reasonable diligence.
6. Any person who has an interest in the property upon which a special assessment has been levied hereunder and the person is aggrieved by this special assessment may, withing forty (40) days after adoption of this Resolution and the date of mailing of this Resolution to the subject person interested in the property by the Village Administrator/Clerk/Treasurer, appeal to the Circuit Court for Milwaukee County, as provided in Section 66.0701 of the Wisconsin Statutes.
