Pursuant to case 25SP1255-850 in the matter of a FORECLOSURE by Evergreen Rising, LLC of a Deed of Trust and by virtue of an Order entered by the Clerk of Superior Court of Surry County, at 2:00PM on the 20th day of April, 2025, Chiarello and Wagner, PLLC, trustee for the lienholder, will offer for sale at a public auction to the highest bidder for cash in the Lobby of the Surry County Courthouse at 201 E Kapp St, Dobson, NC 27017, the current owner of which is Gardenia Gray Properties, LLC, the same lying and being in Surry County, North Carolina, described as follows: BEGINNING at a 60d spike placed within the right of way margin of Ararat Longhill Road (NCSR 2017) and in the southwest corner of property of R.C. East 156.05 feet to a 60d spike, said 60d spike being the POINT OF BEGINNING and containing 0.4593 acres more or less and according to plat and survey of Ricky W. Dalton PLS L-2971, entitled "Survey of the Thelma Peele Welch Estate", dated April 24, 2006. Such property having a street address of: 309 Ararat Longhill Road, Pilot Mountain, NC. The successful bidder will be required to deposit with the Trustee 5% percent of the bid, and the sale will remain open for ten (10) days for advanced or raised bids. The property to be offered pursuant to this notice of sale is being offered for sale, transfer and conveyance "AS IS, WHERE IS." Neither the Trustee nor the Lienholder make any representation or warranty relating to the title or any physical condition relating to the property being offered for sale. Any and all responsibilities or liabilities arising out of or in any way relating to any such condition expressly are disclaimed. This sale is made subject to all prior liens and encumbrances, and unpaid taxes and assessments including but not limited to any transfer tax associated with the foreclosure. An order for possession of the property may be issued pursuant to G.S.45-21.29 in favor of the purchaser and against the party or parties in possession by the clerk of superior court of the county in which the property is sold. Any person who occupies the property pursuant to a rental agreement entered into or renewed on or after October 1, 2007, may, after receiving the notice of sale, terminate the rental agreement by providing written notice of termination to the landlord, to be effective on a date stated in the notice that is at least 10 days, but no more than 90 days, after the sale date contained in this notice of sale, provided that the mortgagor has not cured the default at the time the tenant provides the notice of termination. Upon termination of a rental agreement, the tenant is liable for rent due under the rental agreement prorated to the effective date of the termination.
