Notice of Sale Under Power

JEFFERSON COUNTY
On the 12th day of December, 2024, Charles E. Omdahl and Erika A. Omdahl ("Omdahl") executed a Promissory Note ("Note") and Deed to Secure Debt ("Deed") for One Hundred Thousand Dollars and no/100 ($100,000.00), payable to Reginald Royce Houston and Toni F. Houston, ("Lender"), conveying property described below hereafter and recorded in the Office of the Clerk of Superior Court of Jefferson County, Georgia, in Deed Book 653, Pages 0372-389. Default has been made in the payment of the unpaid matured principal balance, accrued interest and other charges due under the Note and Deed to Secure Debt. Lender declared the entire unpaid indebtedness due and payable in accordance with the terms of said Note, and the same has not been paid. The Deed provides that when the Note secured thereby becomes due and is not paid, that said property may be sold before the Courthouse door of Jefferson County, Georgia, upon Lender first giving notice of the place and terms of such sale one (1) time a week for four (4) weeks in the newspaper in which the sheriff's advertisements are published, and where said property is located.
NOW THEREFORE, pursuant to the powers contained therein, the property will be sold before the Courthouse door in Jefferson County, Georgia, at public outcry on the first Tuesday in November, 2025, between the legal hours of sale the following described property:
ALL that lot or parcel of land, with improvements thereon, situate, lying and being in the State of Georgia, County of Jefferson, and being shown and designated as Parcel "A" containing 18.51 acres and Parcel "B" containing 9.91, as shown on a plat recorded in the Office of the Clerk of the Superior Court of Jefferson County, Georgia, in Plat Book 3, Page 113; reference being made to said plat for a more complete and accurate description as to the metes, bounds and location of said property.
Said property is conveyed subject to that easement reservation identified in that certain deed dated December 3, 2003 and recorded in said clerk's office in Deed Book 361, pages 566-567.
Said property is conveyed subject to and with notice of the following matters: a) drainage easements, building setback lines, and all other matters shown on the plat of record; b) general utility easements and road right-of-way grants and easements.
Said property is hereby conveyed subject to any and all other easements, conveyances of any sort, restrictions and rights of way of record in the aforesaid Clerk's Office.

Lender will convey title to the purchaser as attorney-in-fact for Omdahl. The money derived from the sale will be applied: first to the expenses of said sale; secondly, to the amount due on said Note; and the balance, if any, shall be paid to Omdahl.
TERMS:
Cash, subject to State and County ad valorem taxes or assessment and any federal tax liens of record.
