NOTICE OF SALE UNDER POWER
STATE OF GEORGIA, COUNTY OF RICHMOND
On the 1st of November, 2022, Veggie In Smoothie Bar & Bistro, Inc. , ("Veggie") executed a Promissory Note ("Note") and Security Deed ("Deed") for $220,000.00, payable to Megan Mendez, as Trustee of the Megan Mendez Revocable Trust dated May 27, 2021 ("Mendez"), conveying property described in the below Exhibit "A", and recorded in the Office of the Clerk of Superior Court of Richmond County, Georgia, in Deed Book 1864, pages 2800-2809. Said Note and Deed were subsequently assigned to G & S Capital Management, LLC by Megan Mendez, as Trustee of the Megan Mendez Revocable Trust dated May 27, 2021, by Assignment and Transfer of Security Deed dated April 26, 2023, and recorded in aforesaid Clerk's Office in Deed Book 1886, page 52. Said Note and Deed were subsequently assigned to Megan Mendez, as Trustee of the Megan Mendez Revocable Trust dated May 27, 2021 by G & S Capital Management, by Assignment and Transfer of Security Deed dated June 23, 2025, and recorded in aforesaid Clerk's Office in Deed Book 1974, page 1419. Default has been made in the installment payments due for October 2025 and all months subsequent thereto. In addition, Veggie has failed to pay ad valorem taxes and provide proof of required insurance. Mendez declared the entire unpaid indebtedness due and payable in accordance with the terms of said Note, and the same has not been paid. The Deed provides that when the Note secured thereby becomes due and is not paid, that said property may be sold before the Courthouse door of Richmond County, Georgia, upon Mendez first giving notice of the place and terms of such sale (1) time a week for (4) weeks in the newspaper in which the sheriff's advertisements are published, and where said property is located. Pursuant to the powers contained therein, the property will be sold for cash, subject to State and County ad valorem taxes or assessment and any federal tax liens of record, before the Courthouse door in Richmond County, Georgia, at public outcry on the first Tuesday in December 2025, between the legal hours of sale. Mendez will convey title to the purchaser as attorney-in-fact for Veggie. The money derived from the sale will be applied: first to the expenses of said sale; secondly, to the amount due on said Note; and the balance, if any, shall be paid to Veggie. EXHIBIT "A"
All that lot, tract or parcel of land, with all improvements thereof, situate, lying and being in the 123rd G.M.D, of Richmond County, Georgia, on the East side of Peach Orchard Road (U.S. Highway #25), and being a portion of Lots Number 1, 8 and 9, Block "A" of Fleming Acres Subdivision, as shown on a plat of said subdivision of record in the Office of the Clerk of the Superior Court of Richmond County, Georgia in Realty Book 17-J, page 95. Said property is more particularly shown on a plat prepared by J.B. Wells, surveyor, dated February 22, 1950, which plat is recorded in the aforesaid Clerk's Office in Realty Book 17-P, page 465, and to which plat reference is hereby made for a more particular description as to the metes, bounds, courses, distances and location of said property. The improvements on said property are known under the present system of street numbering in Richmond County as 2516 Peach Orchard Road, Augusta, Georgia. LESS AND EXCEPTING THEREFROM that portion of the aforesaid described property heretofore taken for the widening of U.S. Highway Number 25 in Civil Action No. 9610-A in the Superior Court of Richmond County, Georgia. Being the same property conveyed by Jagdish K. Shah, Dinesh K. Shah, and Dhananjay Shah to Girish K. Shah by a Warranty Deed dated January 20, 2006, and recorded in the Office of the Clerk of Superior Court in Book 1044, page 1716. Said property is conveyed subject to and with notice of the following matters: a) drainage easements, building setback lines, and all other matters shown on the plat of record; b) general utility easements and road right-of-way grants and easements. Said property is conveyed subject to a Georgia Power Easement recorded in Realty Book 35-T at page 976, aforesaid records. Said property is hereby conveyed subject to any and all other easements, restrictions and rights of way of record in the aforesaid Clerk's Office.
