On the October 18, 2023 Ernestine O'Conner, ("O'Conner") executed a Consumer Note ("Note 1") for $292,643.18, secured by a Deed to Secure Debt "Deed") dated July 12, 2021, payable to First State Bank ("First State"), conveying property described as follows: ALL THAT LOT, TRACT OR PARCEL OF LAND, with improvements thereon, situate, lying and being in the State of Georgia, County of Richmond, and being known and designated as TRACT 47; CONTAINING 2.32 ACRES, MORE OR LESS, LOCATED ON THE WEST SIDE OF "WILLIS FOREMAN ROAD', as more particularly shown on a plat thereof prepared by Robert L. Herrington, Ga. R.L.S, dated August 10, 1992, FOR FALL LINEEQUITIES, INC., SHOWING A PORTION OF TRACT "B", AS SHOWN ON PLAT DATED DECEMBER 11, 1991, REVISED FEBRUARY 6, 1992, PREPARED BY JAMES G. SWIFT & ASSOCIATES FOR THE ESTATE OF ROBERT WALTON, which plat is being filed for record in the Office of the Clerk of Superior court of Richmond County, Georgia, in Plat Book 1782, Page 336 simultaneously herewith. Reference is hereby made to said plat for the purpose of providing a more complete and accurate description as to the metes, bounds, courses, distance, and location of said property. Tax map and parcel #: 165-0-056-00-0. 2802 Willis Foreman Road, Hephzibah, GA 30815. Said Deed to Secure Debt is recorded in the Office of the Clerk of Superior Court of Richmond County, Georgia, in Deed Book 1797, page 1086. In addition, O'Conner executed Promissory Note ("Note 2") dated October 9, 2024, for $11,254.60 secured by the aforesaid Deed. Default has been made in the installment payments due on Note 1 for December, 2024 and all months subsequent thereto. Default has been made in the installment payments due on Note 2 for January, 2025, and all months subsequent thereto. First State declared the entire unpaid indebtedness due and payable in accordance with the terms of Note 1 and Note 2, and the same has not been paid. The Deed provides that when the Notes secured thereby become due and are not paid, that said property may be sold before the Courthouse door of Richmond County, Georgia, upon First State first giving notice of the place and terms of such sale (1) time a week for (4) weeks in the newspaper in which the sheriff's advertisements are published, and where said property is located. NOW THEREFORE, pursuant to the powers contained therein, the property will be sold before the Courthouse door in Richmond County, Georgia, at public outcry on the first Tuesday in July, 2026, between the legal hours of sale. First State will convey title to the purchaser as attorney-in-fact for O'Connor. The money derived from the sale will be applied: first to the expenses of said sale; secondly, to the amount due on said Notes; and the balance, if any, shall be paid to O'Conner. TERMS: Cash, subject to State and County ad valorem taxes or assessment and any federal tax liens of record. Purchaser is to pay for all legal papers and revenue stamps. This 1st day of June 2026.
