NOTICE OF SERVICE OF PROCESS BY PUBLICATION STATE OF NORTH CAROLINA, COUNTY OF BUNCOMBE IN THE GENERAL COURT OF JUSTICE, SUPERIOR COURT DIVISION 25CV004965-100 FOUNDERS FEDERAL CREDIT UNION, Plaintiff, vs. MITCHELL DEWAYNE DICKENS, JR., Defendant. TO: MITCHELL DEWAYNE DICKENS, JR. TAKE NOTICE that a pleading seeking relief against you has been filed in the above-entitled action. The nature of the relief being sought is as follows: On or about July 28, 2022, Mitchell Dewayne Dickens, Jr. ("Defendant") executed a Membership and Account Application and Account Card (the "Application") and agreed to be bound by the Membership Agreement and Disclosures (the "Credit Union Booklet") with Founders Federal Credit Union ("Plaintiff"). Thereafter, on or about August 10, 2022, and subject to the Credit Union Booklet, Plaintiff advanced funds to Defendant as shown on the Security Agreement and Advance Receipt (the "Note"). Defendant failed to make payments when due on the Credit Union Booklet and the Note. After providing all credits due to Defendant on the Credit Union Booklet and the Note, Defendant owes Plaintiff the sum of no less than $21,324.15, plus interest accruing thereon at the rate of $5.93 per day from and after April 24, 2025 until the date of judgment, and thereafter at the lower of the maximum legal rate or the rate of the Note until paid and attorney's fees, pursuant to the Credit Union Booklet, the Note, and N.C. Gen. Stat. § 6-21.2 in the amount of $3,198.62, which is 15% of the amount due under the Credit Union Booklet and the Note. Thereafter, on or about March 1, 2024 Defendant engaged in several transactions which caused an overdraft on Checking Account No. XXXXXXXXXX0070 (the "Checking Account"). Defendant failed to make payments when due on the Credit Union Booklet and Checking Account. After providing all credits due to Defendant on the Credit Union Booklet and the Checking Account, Defendant owes Plaintiff the sum of no less than $530.40 plus interest accruing thereon from and after the date of judgment at the maximum legal rate until paid and attorney's fees, pursuant to the Credit Union Booklet, the Checking Account, and N.C. Gen. Stat. § 6-21.2 in the amount of $79.56, which is 15% of the amount due under the Credit Union Booklet and the Checking Account. You are required to make defense to such pleading no later than December 8, 2025, said date being 40 days from the date of first publication of this notice, and upon your failure to do so the party seeking service against you will apply to the court for the relief sought.
