TAKE NOTICE that a pleading seeking relief against you, styled AMENDED PETITION FOR PARTITION OF REAL PROPERTY, and CONTRIBUTION regarding the proposed sale of real property between co-tenants, has been filed in the above-captioned proceeding now pending in the Superior Court of Madison County, North Carolina, File No. 26SP000006-560, before the Clerk of the Superior Court of Madison County.
The nature of the relief being sought is a private sale of a real property parcel is located in Madison County, at the address of 3645 Meadow Fork Rd., Hot Springs, NC28743 with parcel identification number of 8747-32-4071. The Property is further described in the deed recorded in the Madison County Registry, Deed Book 511 Pages 24-26 and is owned by co-tenants (parties of the suit). The proposed sale is in lieu of an actual partition of land, along with recovery of contribution for carrying costs and assessment of counsel fees as permitted by law. All respondents are further notified: A respondent has the right to seek the advice of an attorney and that free legal services may be available to the respondent by contacting Legal Aid of North Carolina or other legal services organizations and that pursuant to G.S. 46A-3, the court may order reasonable attorneys' fees to be paid as a part of the costs of the proceeding.
You are required to make defense to such pleading not later than forty (40) days from June 10, 2026 the date of the first publication of this Notice, said deadline being July 20, 2026. Upon your failure to do so, the party seeking service against you will apply to the Court for the relief sought. This Notice is given in compliance with the requirements of N.C. Gen. Stat. § 1A-1, Rule 4.
